[ PRC RESOLUTION NO. 04-246, S. 2004, October 29, 2004 ]

SPECIAL LICENSURE EXAMINATIONS FOR OVERSEAS FILIPINO WORKERS (OFWS) IN SAUDI ARABIA



WHEREAS, Section 7(d) of the "PRC Modernization Act of 2000" (R.A. 8981), provides:

"Sec. 7. Powers, Functions and Responsibilities of the Commission x x x:

(d)   To administer and conduct the licensure examinations of the various regulatory boards in accordance with the rules and regulations promulgated by the Commission; determine and fixed the places and dates of the examinations; x x x adopt measures to preserve the integrity and inviolability of licensure examinations; x x x" (Emphasis supplied)

WHEREAS, the opinion of the Department of Justice (DOJ) dated August 27, 2004, states that the aforementioned law clearly grants the Commission the power to conduct the licensure examinations and to determine the places where they shall be conducted subject to adoption of the necessary measures to preserve the integrity and inviolability of the examinations.

WHEREAS, the DOJ further stated that the Commission as an administrative agency tasked to implement a law should not concern itself with the necessity, adequacy, wisdom or reasonableness and expediency of any law as it is within the province of the legislature.  Hence, pragmatic considerations, such as the small number of examinees, should not hinder the Commission from conducting licensure examinations abroad pursuant to its mandate.

WHEREAS, the Office of Sen. Franklin M. Drilon has already allocated to the Commission ONE MILLION SEVEN HUNDRED THOUSAND (P1,700,000) PESOS from his Priority Development Assistance Fund (PDAF) for the conduct and administration of the special licensure examinations for OFWs in Saudi Arabia.

WHEREFORE, the Commission, RESOLVES, as it is hereby RESOLVED, to conduct and administer for special licensure examinations for OFWs in Saudi Arabia.

Let a copy of this resolution be published in the Official Gazette or newspaper of general circulation and furnished the U.P. Law Center.
