WHEREAS, Section 31, Article III of R.A. No. 9280, known as the "Customs Brokers Act of 2004", states, to wit:

"Section 31. Accredited Professional Organization. - All professional customs brokers shall have one national organization which shall be recognized by the Board and by the Commission as the one and only accredited professional organization of customs brokers.  A professional customs broker duly registered with the Board shall automatically become a member of the accredited professional organization of customs brokers and shall receive the benefits and privileges appurtenant thereto.  Membership in the accredited professional organization of customs brokers shall not be a bar to membership in other associations of customs brokers". (Underscoring supplied);

WHEREAS, on August 5, 2004, the Chamber of Customs Brokers, Inc.  (CCBI) submitted with the Commission its Petition for Accreditation as the National Professional Organization of Customs Brokers;

WHEREAS, an evaluation of the corporate papers of CCBI shows that it is a non-stock, non-profit corporation duly registered with the Securities and Exchange Commission (SEC) under SEC Reg. No. 172048 on January 5, 1990;

WHEREAS, the CCBI invokes the hereunder considerations, standards, and factors:

1. The Chamber of Customs Brokers, Inc. is still and continues to be the accredited professional organization (APO) of customs brokers by the Professional Regulation Commission under its Certificate of Accreditation No. 36 dated November 30, 1991;
   
   
2. The CCBI, being the national organization of all customs brokers in the Philippines, with over 3,000 members, establishes and maintains its chapters offices in Cebu, Davao, Cagayan de Oro, Zamboanga, General Santos, Batangas, and Subic.  Thus, CCBI is not only representative of the profession but the only national organization of customs brokers which conducts trainings, seminars, and forums to update and enhance the knowledge and skills of its member;
   
   
3. The CCBI is the national organization of customs brokers which ardently advocated, sponsored, and supported the enactment of a law regulating the practice of the Profession.  Thus, Republic Act No. 9280, known as the "Customs Brokers Act of 2004", was signed into law by President Gloria Macapagal Arroyo on March 30, 2004;
   
   
4. The Amended By-Laws of the Chambers of Customs Brokers, Inc. provides that membership thereon are open to all registered customs brokers without discrimination.  The provision on membership as specified in Article 111 of the By-Laws, states, to wit:
   
   

   "Section 1-All customs brokers whose names are in the roll of Customs Brokers of the Professional Regulation Commission are considered members of the Chambers of Customs Brokers, Inc.  All customs brokers whose names are in the roll of Customs Brokers of the Civil Service Commission are also considered members of the association."

WHEREAS, all the foregoing considerations clearly indicate that the integration of the Customs Brokers profession as mandated by R.A. No. 9280 will be better served by the accreditation of the CCBI as the one and only Accredited Professional Organization of Customs Brokers; and

WHEREAS, CCBI's documents and papers in support of the Petition therefor are in order, since they are in accordance with the PRC Res. No. 2004-178, Series of 2004 and other pertinent issuances or policies;

NOW, THEREFORE, the Board hereby resolved, as it now resolves, to grant, subject to approval by the Commission, the Chamber of Customs Brokers, Inc.'s (CCBI) Petition for Recognition or Accreditation by the Board and the Commission as the Accredited National Professional Organization of Customs Brokers by virtue of Sec. 31, Art. III of R.A. No. 9280, known as the "Customs Brokers Act of 2004", and, accordingly, to issue thereto the Certificate of Accreditation signed by the Chairman and Members of the Board and the Chairperson of the Commission upon payment of the prescribed fee therefor pursuant to Rule 2 of Res. No. 2004-178, Series of 2004.

FURTHER RESOLVED, as the ANPOCB, the CCBI is hereunto enjoined:

1. To encourage registered and licensed customs brokers who are not yet members of the Chamber of Customs Brokers, Inc. to join the said organization.
   
   
2. To ensure the accomplishment of the purposes, duties, and responsibilities prescribed in R.A. No. 8981 and R.A. 9280 and their IRR's and the Articles of Incorporation and By-laws of the Chamber of Customs Brokers, Inc.
   
   
3. To keep and make up-to-date its Roster/Roll of Members.
   
   
4. To charge and collect reasonable fees from its members and provide them the benefits and privileges they are entitled to, pursuant to the Articles of Incorporation and By-laws of the Chamber of Customs Brokers, Inc.
   
   
5. To motivate the members to undergo the Continuing Professional Development/Education (CPD/E) Programs.
   
   
6. To comply with the relevant rules in Res. No. 2004-178, Series of 2004.

FURTHERMORE, RESOLVED, this Resolution shall take effect after fifteen (15) days following its full and complete publication in the Official Gazette or any newspaper of general circulation in the Philippines.
