[ LTFRB MEMORANDUM CIRCULAR NO. 99-010, June 14, 1999 ]

BAN/PROHIBITION AGAINST THE DISPLAY POSTING OF PORNOGRAPHIC MATERIAL ON PUBLIC UTILITY VEHICLES



The Board has observed that public utility operators are posting and displaying pornographic and/or lewd material on their vehicles, particularly on buses and FX units. This practice, not only violate public morals but could also compromise and endanger public safety.

This practice of public utility operators of posting and displaying pornographic and/or lewd materials on any part of their vehicles is, therefore strictly prohibited.

Accordingly the Board hereby directs operators whose units has such pornographic and/or lewd material on any part thereof to immediately remove the same.

Pornographic and lewd material strictly prohibited from public exhibition or display by posting in public utility vehicles is any material that, when taken as a whole and applying contemporary standards, appeals to the prurient interest of an average person, that which depicts or describes, in a patently offensive way any sexual conduct; or that which lacks serious literary, artistic, political or scientific value.

Failure to comply with this Memorandum Circular shall subject the offending operator concerned to the following fines/penalties:

1.First Offense P1,000.00
   
2.Second Offense 3,000.00
   
3.Third Offense 5,000.00
   
4.Fourth Offense Suspension of the unit/s' authority to operate

This Memorandum Circular shall take effect fifteen (15) days after the filing of three (3) copies with the U.P. Law Center in accordance with Presidential Memorandum Circular No. 11, dated October 9, 1992, and any or all Board issuance's inconsistent herewith are hereby modified accordingly, superseded and/or revoked.
