RESTRICTING GLARE/DAZZLE ON PUBLIC HIGHWAYS



International traffic rules are designed to minimize if not prevent glare/dazzle. This is one of the most common traffic nuisance/hazard in the country. It may be caused by any of the following:

1. Glare from the direct rays of the sun at daytime or direct rays of vehicular lights due to failure to dim headlights or broken tail light lens, unauthorized rear/side/spot white or neon lights at night time;

2. Glare from reflected light on stainless owner-type jeeps/AUV's/Chrome/nickle plated body parts/components and/or accessories with glossy/mirror/ brilliant/shiny finish.

Pursuant to Section 4(d) (1) in relation to Section 34 RA 4136 as amended, PD 96 and the provisions of Article 33 of the Vienna Convention of 1968 as amended the following rules and regulations are hereby promulgated for guidance and observance of all concerned:

No motor vehicle:

a. whose front and/or rear body component parts/accessories are chrome/nickle plated or made of stainless steel with glossy/mirror/brilliant/shiny finish (owner -type jeep/auv's); or

b. sporting dazzling headlights, broken tail light lens, unauthorized rear/side/spot white or neon lights of any color (except white rear plate and back up light) shall be accepted for original or renewal registration nor allowed to operate on public roads and highways.

Owners of the aforecited motor vehicles already registered prior to the effectivity of this circular shall have three (3) months within which to eliminate the glare from their vehicles and dazzling accessories either by replacement or alteration to have a flat, dull, brush or hairline finish etc. After this period, motor vehicles found operating on public roads and highways with glaring front or rear body parts and/or sporting dazzling accessories shall be impounded and their owner penalized with a fine of five hundred pesos (P500.00).

All previous orders/memoranda and other issuances in conflict herewith are deemed superseded.

This memorandum circular shall take effect fifteen days (15) after the filing of three (3) copies hereof with the University of the Philippines Law Center, in accordance with Presidential Memorandum No. 11, dated October 9, 19992 and publication thereof in a newspaper of general circulation.
