[ PAB RESOLUTION NO. 01, s. 2002, March 06, 2002 ]

COMMITTEE ON FINES



WHEREAS, the PAB recognizes the need to extensively review pollution cases with pending issue on fines/penalty to arrive at a more just and impartial decision with regard to its imposition;

WHEREAS, it was observed that a number of concerns/circumstances surrounding the cases with remaining issues on fines/penalty warrants the need for a more intricate study, which would require the expertise of both legal and technical personnel for a more justified recommendation on the case;

WHEREAS, the PAB perceives the need for a committee that would review pollution cases with pending issue on fines/penalty imposable against violators and to aide the Board in arriving at a just and impartial decision;

RESOLVED, as it is hereby resolved, that the committee shall be called Committee on Fines which is primarily assigned to conduct a review on the above-mentioned pollution cases, and to come up with an appropriate recommendation to the Board for the proper resolution thereof.

FURTHER, RESOLVED, that the Committee on Fines shall be composed of a Chairman and Co-Chairman which shall come from the Members of the PAB, one (1) Legal Counsel and three (3) members of the technical secretariat.
