AMENDMENT TO MEMORANDUM CIRCULARS NUMBERS 2001-003 AND 2002-002 (LATE FILING OF PETITION FOR EXTENSION OF VALIDITY)

To answer the clamor for the Board to allow late filing of petition for extension of validity of all types of public utility vehicles EXCEPT buses, mini-buses and coaches, the Board hereby resolves to extend the effectivity of Memorandum Circulars Nos. 2001-003 and 2002-002, to read:

“The Board allows the acceptance and processing of petitions/applications for extension of validity whose franchises expired as of January 1, 1997 or thereafter, provided that the petitions/applications shall cover not more than two (2) units per case number, that during the Formal Offer or Evidence, the said unit/s is/are still in the name of the petitioner or applicant; and that dropping and/or substitution of unit on the expired franchise is not allowed to avoid the circumvention of this MC.”

Other conditions and restrictions found in Memorandum Circular Nos. 2001-003 and 2002-002 shall continue to have force and effect.

This Memorandum Circular shall apply to all types of public utility vehicles, except buses, mini-buses and coaches.

All other issuances or parts thereof which are inconsistent herewith are heretofore modified or superseded accordingly to conform with new MC.

This Memorandum Circular shall take effect immediately and ends automatically on 31 December 2002 unless extended by the Board.
