GUIDELINES IN THE RENEWAL OF DRIVER'S LICENSE AND/OR ISSUANCE THEREOF WHOSE HOLDERS/APPLICANTS WERE FOUND POSITIVE FOR THE USE OF PROHIBITED DRUGS ENUMERATED UNDER MEMORANDUM CIRCULAR NO. EMA MC 01228-A



For the information and guidance of all concerned, effective immediately, the following guidelines shall be strictly observed and followed in the issuance or renewal of Professional and Non-professional driver's licenses and renewal thereof of applicants/holders who have been found positive for the use of prohibited drugs enumerated under Memorandum Circular No. EMA-MC 01228-A, to wit:

1. Applicants of Non-professional and Professional Driver's Licenses who have been found positive for the use of prohibited drugs shall be barred from reapplying for any of the above-licenses within the period of six (6) months;

2. Holders of the aforementioned driver's licenses, who have been confirmed positive for the use of prohibited drugs, shall be barred from renewing their license within the period of six (6) months;

3. Applicants for issuance of the aforementioned driver's licenses, who have been found positive for the use of illegal drugs after the lapse of six (6) months prohibitory period, shall be barred forever from re-applying for any driver's licenses;

4. The driver's licenses of the holders, who were confirmed positive after the lapse of six (6) months prohibitory period, shall be confiscated and considered revoked;

5. No drug test results shall be accepted unless applicants for the aforementioned driver's licenses and holders thereof for renewal shall have first secured a duly accomplished drivers license application form from the concerned district office and/or licensing center for monitoring, controlling, docketing and safekeeping of the driver's license for renewal;

6. The driver's licenses of the holders thereof, who have been confirmed positive for the use of drugs, shall not be renewed unless he/she has complied with the six (6) months prohibitory period and provided that he/she passed the second drug test requirement;
