SUSPENSION ON THE PROCESSING OF APPLICATION FOR ISSUANCE OF CPC TO OPERATE TOURIST TRANSPORT SERVICE UNDER THE SUB CLASSIFICATION OF CORPORATE TRANSPORT LEASING SERVICES



Records of this Board disclosed that substantial number of Applications for Issuance of Certificates of Public Convenience to Operate Tourist Transport Services under the sub-classification of Corporate Transport Leasing Services have been filed and accepted, despite the agreement between the Board and the Regional Directors not to accept Application of said nature, and which paves to the circumvention of existing moratorium on Applications for Tourist Transport Services under the classification of Tourist Car and Bus Services. Thus, this Board is hereby reiterating the aforesaid moratorium on Applications for Tourist Transport Services under different classification, including Application for Corporate Transport Leasing pending review and evaluation pertaining to issuances and memoranda regarding Tourist Transport Service.

Accordingly, be it clarified that acceptance of Applications for Tourist Car Services under the sub classification Corporate Transport Leasing Services pursuant to MC 2006-058 should not be allowed beginning May 30, 2008, the effectivity date of Memorandum Circular No. 2008-009, Re: SIMPLIFYING CLASSIFICATIONS OF TOURIST TRANSPORT SERVICES PURSUANT TO DEPT. ORDER NO. 97-1097, MEMORANDUM CIRCULAR NOS. 98-002, 2003-001, 2004-01, 2004-026, 2005-033, 2006-049, 2006-058 AND RELATED ISSUANCES TO OBVIATE CONFUSION AND MISAPPREHENSION OF THE KIND OF SERVICES PROVIDED AND THE UNITS TO BE AUTHORIZED dated May 13, 2008. All pending applications of this nature, which were received by the Board and the Regional Offices shall be held in abeyance, and should be endorsed to the LTFRB Central Office for appropriate action and disposition.

All issuances inconsistent herewith are hereby superseded and amended accordingly. This Memorandum Circular shall take effect immediately.
