[ POEA MEMORANDUM CIRCULAR NO. 59 S. 1992, July 08, 1992 ]

PROCEDURES FOR PERFORMING ARTIST EXEMPTED FROM THE AGE 23 REQUIREMENT



Filipino performing artists who are exempted from the age 23 requirement pursuant to Section 2 (Exemptions) and Section 6 (Transitory Provisions on Returning Performing Artists) of the Administrative Guidelines Implementing Department Circular 01-91 dated 13 December 1991 and Department Circular 5-A, Series of 1992 shall be governed by the following procedures:

SECTION 1. Request for Exemption - The following shall be the procedures in requesting for exemption under Section 2 and Section 4 of abovementioned Administrative Guidelines and Department Circular 5-A, respectively:

1. All requests for exemption to the age 23 requirement shall be addressed and submitted to the Office of the Secretary of Labor. Requesting applicants must provide documentation that will qualify them for exemption such as the following:
  1. For those exempted under Section 2
    1. Letter of invitation to perform for a charitable cause, certified by the Philippine Embassy/Consulate

    2. News and magazine clippings/reviews of the artist's performance(s)

    3. Albums/portfolio/pictures of performances

    4. Record/cassette covers of singers

    5. Layout of performance advertisements

    6. Employment certification from reputable hotels and performance venues.

    7. Diploma or Certificate of Training from a performing arts school including that from duly accredited Human Resource Development Centers for Performing Artists (HRDCPA) per DOLE Circular 06, Series of 1992
  2.  For returning artists whose employer/promoter is not an association member
    1. Booking Contract

    2. Passport
2. Approval or disapproval for such request shall be made within ten (10) days for performing artists being deployed for the first time and within one (1) day for returning artists.

3. All actions on exemption requests shall be relayed by the Office of the Secretary of Labor (OS) to POEA.

4. Where the Office of the Secretary submits to the POEA requests for exemptions, the same shall be evaluated and appropriate recommendations shall be made by the POEA.

5. Upon receipt of the documents from the Office of the Secretary, POEA shall notify the requesting party (i.e. Philippine recruitment agency) of the approval or disapproval.

6. POEA shall process the documents of the exempted worker and issue the coded Overseas Employment Certificate (OEC).

SECTION 2. Processing of Exempted Performing Artists - The following documents shall be submitted to the Employment Contract Processing Branch (ECPB) for processing:
  1.  For those exempted under Section 2:

    1. Recruitment Order

    2. Working Visa/Certificate of Eligibility

    3. Accreditation Certificate

    4. Employment Contract

    5. Insurance Certificates

    6. Repatriation Bond

    7. Accomplished ID forms per worker reflected in the ROs.

    8. Information Sheet

    9. Pre-Departure Orientation Certificate

    10. Exemption approval from the Secretary of Labor

  2. For returning performing artists:

    1. Recruitment Order

    2. Working Visa/Certificate of Eligibility

    3. Accreditation Certificate

    4. Employment Contract

    5. Insurance Certificates

    6. Repatriation Bond

    7. Accomplished ID forms per worker reflected in the ROs

    8. Information Sheet

    9. Passport

    10. Booking Contract

    11. Endorsement of employer association, per Section 4 No. 1 of DC5-A or

    12. Exemption approval from the Secretary of Labor
This Circular shall take effect immediately.
