[ BC CUSTOMS ADMINISTRATIVE ORDER NO. 9-2007, October 09, 2007 ]

PURSUANT TO EXECUTIVE ORDER NUMBER 375, ENTITLED “MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IRON AND STEEL PRODUCTS UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1464), AS AMENDED”, AND THE RULES AND REGULATIONS TO IMPLEMENT THEREOF (JOINT DTI-BOI, DOF, NEDA, AND BOC ADMINISTRATIVE ORDER NO. 01, SERIES OF 2006)



I. OBJECTIVES

To implement the MFN Tariff rate modification from three percent (3%) to seven percent (7%) on the hot-rolled (HR) and cold-rolled (CR) steel listed in Annex A of Executive Order No. 375, and as provided for in the Joint DTI-BOI, DOF, NEDA and BOC Administrative Order No. 01, series of 2006.

II. SCOPE

This Order shall cover shipments of hot-rolled (HR) and cold-rolled (CR) steel listed in Annex A of Executive Order No. 375, entered at all ports in the country.

III. ADDITIONAL RULES AND REGULATIONS

The Commissioner of Customs may issue additional rules and regulations for the effective implementation of this order.

IV. TRANSITORY PROVISIONS

Articles “loaded on board” on or before the effectivity date of this Order shall still enjoy the three percent (3%) MFN tariff rate.

V. REPEALING CLAUSE

All Orders, Memoranda, Circulars or parts thereof which are inconsistent with this Order are hereby deemed repealed and/or modified accordingly.

VI. SEPARABILITY CLAUSE

If any part or parts of this Order should for any reasons be held to be invalid or unconstitutional, the remaining parts hereof shall remain in full force and effect.

VII. EFFECTIVITY

This Order shall take effect immediately upon publication in a newspaper of general circulation.
