[ LTFRB MEMORANDUM CIRCULAR NO. 92-006, July 15, 1992 ]

COMPLIANCE BY ALL PUBLIC UTILITY OPERATORS WITH SECTIONS 6 AND 20 OF REVISED ORDER NO. 1 REGARDING THE APPROVAL OF A COMMERCIAL/BUSINESS NAME AND COLOR DESIGN OR COMBINATION



It has been observed that there is a proliferation of public utilities using Commercial or Business Name or color designs or combinations which have not been approved by the Board.

This has resulted in confusion and failure to properly identify these public utilities in case of any need therefor and for the purpose of aiding the authorities concerned, particularly the law enforcement agencies of the government.

In view thereof, and pursuant to the power vested upon the Board to promulgate rules and regulations for reasons of public interest and safety, all public utility operators are hereby directed to comply with Sections 6 and 20 of Revised Order No. 1 which states, as follows:

SECTION 6. Commercial Or Business Name - No operator shall adopt a commercial or business name without first securing the approval of the Commission (now the Board).

SECTION 20. Color Design - No operator shall adopt a color design or combination of colors to be used on his motor vehicle without first securing the approval of the Commission (now the Board).

The Receiving and Assessment Section is hereby directed to observe and/or enforce the foregoing Memorandum Circular:

1. The operators concerned are hereby directed to file the necessary petitions, motions or pleadings to comply with this Memorandum Circular immediately upon release hereof;

2. This Memorandum Circular shall take effect after forty-five (45) days from date hereof to accord sufficient time and notice to all public utility operators concerned;

3. Thereafter, no application, petition, motion or any similar pleadings shall be accepted for filing unless the operators concerned can show proof of compliance with this Memorandum Circular or that they have filed the necessary petition to comply with this Circular.
