[ BC CUSTOMS MEMORANDUM ORDER NO. 33-2007, October 26, 2007 ]

IMPLEMENTING CAO 9-2007 ENTITLED: “PURSUANT TO EXECUTIVE ORDER NUMBER 375 ENTITLED, “MODIFYING THE RATES OF IMPORT DUTY ON CERTAIN IRON AND STEEL PRODUCTS UNDER SECTION 104 OF THE TARIFF AND CUSTOMS CODE OF 1978 (PRESIDENTIAL DECREE NO. 1404), AS AMENDED,” AND THE IMPLEMENTING RULES AND REGULATIONS THEREOF (JOINT DTI-BOI, DOF, NEDA AND BOC ADMINISTRATIVE ORDER NO. 01, SERIES OF 2006)



Section 1. Covered Articles – Importations of Hot-Rolled (HR) and Cold Rolled (CR) steel listed in Annex “A”  of Executive Order No. 375 and as provided for under the Joint DTI-BOI, DOF, NEDA AND BOC Administrative Order No. 01, series of 2006, entered in all ports in the country shall be imposed as MFN tariff rate of duty at seven percentum (7%) effective October 21, 2007.

Section 2. Cut-Off Period – For purposes of this Order, articles “loaded on board” on or before the effectivity date of October 21, 2007 shall mean the date when the articles bound for export to the Philippines are actually loaded into the carrying vessel as reflected in the Bill of Lading (B/L).

Section 3. Repealing Clause – All Orders, Memoranda, Circulars or parts thereof inconsistent with this Order are hereby deemed repealed and/or modified accordingly.

Section 4. Separability Clause – If any part or parts of this Order should for any reason be held invalid or unconstitutional, the remaining parts hereof shall remain in full force and effect.

Section 5. Effectivity – This Order shall take effect immediately.
