[ PPA MEMORANDUM CIRCULAR 32-95, June 26, 1995 ]

CLARIFICATION ON REDUCED WHARFAGE, DOCKAGE AND USAGE FEES EXTENDED TO OFFICIALLY REGISTERED PRIVATE PORTS PER PPA MC 07-94



Pursuant to PPA Memorandum Circular No. 07-94, dated 09 March 1994, and in order to allow uniform interpretation and implementation of the provisions on reduced wharfage, dockage and usage fees extended to "officially registered ports", the following clarification is hereby issued.

1. "Officially registered private ports" shall refer to private ports issued by the Philippine Ports Authority with Certificate of Registration, whether temporary or permanent.

2. Payments of wharfage, dockage and usage fees accruing to cargoes or vessels serviced in PPA officially registered private ports shall be equivalent to only 50% of those serviced in government ports.

The privilege on reduced fees extended to private ports with temporary Certificate of Registration shall automatically cease upon the termination of its temporary authority.

The privilege on reduced fees given to private ports with permanent but expired Certificate of Registration shall be extended for a maximum period of 6 months to allow the private owner sufficient time to complete the required documents, provided an application for the renewal of the foreshore lease and PPA permit to operate shall be made prior to the lease and operating expiration.

All issuances inconsistent with the above provision are hereby modified accordingly.

This Memorandum Circular shall take effect immediately.
