[ SRA SUGAR ORDER NO. 11, August 28, 1996 ]

FILLING UP THE U.S. QUOTA FOR QUOTA YEAR 1996-97 UNDER CERTAIN CONDITIONS



WHEREAS, the United States has allocated for the Philippines a Sugar Quota for Quota Year 1996-1997, said quota to be officially announced later;

WHEREAS, it is to the advantage of the sugar industry to fill up the First Quarter U.S. Quota at the earliest possible time and help prevent the further decline of sugar prices in the domestic market, due to the presence of considerable supply of locally produced and imported sugar, by allowing our "B" or Domestic sugar to fill up the aforesaid U.S. Sugar Quota;

NOW, THEREFORE, under and by virtue of the Authority vested in the Sugar Regulatory Administration (SRA), it is hereby ordered that:

SECTION 1. The U.S. Sugar Quota for Quota Year 1996-1997 when announced officially shall be allocated on a quarterly basis;

SECTION 2. All domestically produced raw cane sugar classified as "B" shall be eligible for export as advance swapped "A" to fill up the First Quarter Quota while for the rest of the Quarters, the class of sugar eligible for export shall be subject to review or assessment by the SRA;

The 'A' or U.S. Quota Sugar domestically produced during previous crop years cannot participate in filling up the abovementioned U.S. Quota;

SECTION 3. The "B" or Domestic sugar exported to fill up the First Quarter Quota shall be replenished with the "A" or U.S. Quota sugar produced during Crop Year 1996-1997 at a ratio of 1:1.25 (1 unit volume of "B" to 1.25 unit volume of "A") while for the rest of the Quarters shall also be subject to review or assessment by the SRA.

SECTION 4. The "B" or Domestic sugar quedan permits to cover the withdrawal of sugar for export under this Sugar Order when submitted to the SRA for processing, shall be charged with a processing fee (Advanced Swapping) of P15.00 per M.T. (P0.75/LKg-Bag), in addition to the P9.00 per M.T. (P 0.45/LKg-Bag) as Export Clearance fee, while the "A" or U.S. Quota sugar quedan-permits to cover the withdrawal for export shall be charged with P9.00 per M.T. (P 0.45/LKg-Bag) as Export Clearance fee.

SECTION 5. A Circular Letter shall be issued to prescribe the guidelines to implement this Sugar Order.

SECTION 6. Provisions of Sugar Order, Circular Letter, and/or other rules and regulations contrary to or inconsistent with this Sugar Order, are hereby amended, modified or revoked accordingly.
