[ MMDA REGULATION NO. 99-008, May 06, 1999 ]

REQUIRING DRIVERS AND OPERATORS OF MOTOR VEHICLES APPREHENDED FOR THE THIRD TIME FOR NON-SUSPENDABLE VIOLATIONS TO UNDERGO REORIENTATION SEMINAR



WHEREAS, the Department of Transportation and Communication (DOTC) issued Memorandum Order No. 90-379 directing MMDA to conduct orientation seminars and training for drivers/operators of motor vehicles who were apprehended for the third time within one (1) year reckoned from the last birthday;

WHEREAS, the same department circular has authorized the MMDA to collect a fee from driver/motorist attending said orientation and re-training seminars;

WHEREAS, the imposition of service and regulatory fees are sanctioned by powers and duties that are expressly granted by law under RA 7924, which provides:
"Sec 6 [d] Functions of the Metro Manila Council — x x x

[d] It shall promulgate rules and regulations and set policies and standards for metro-wide application governing the delivery of basic services, prescribe and collect service and regulatory fees and impose and collect fines and penalties."
NOW, THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby promulgated and adopted by the Metro Manila Council, that:

SECTION 1. Coverage — All drivers/operators of motor vehicles who were apprehended for the third time shall be required to attend reorientation and re-training seminars to be conducted by the Traffic Operations Center, Metropolitan Manila Development Authority.

SECTION 2. Seminar Fee — A seminar fee not exceeding THREE HUNDRED [P300.00] PESOS shall be collected from each driver/operator of motor vehicle undergoing a reorientation and re-training seminar.

SECTION 3. Collection of Fee — The seminar fee herein authorized shall be paid directly to the Treasury Operations Service, Office of the Assistant General Manager for Finance and Administration, MMDA, Guadalupe, Makati City.

SECTION 4. Effectivity — This Regulation shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation.
