[ PRC BOARD FOR MARINE DECK OFFICERS RESOLUTION NO. 08-12, S. OF 2008, May 02, 2008 ]

IMPLEMENTATION OF THE APPROVED EDUCATION AND TRAINING UNDER PARAGRAPH 2, REGULATION II/2 OF THE 1978 STCW CONVENTION, AS AMENDED



WHEREAS, paragraph 2, Regulation II/2 of the 1978 STCW Convention, as amended, provides that candidates for certification as Master and Chief Mate on ships of 500 gross tonnage or more must have completed the approved education and training and meet the standards of competence specified in section A-II/2 of the STCW Code.

WHEREAS, in compliance with the said requirement, the Maritime Training Council (MTC) developed an approved education and training program for candidates for certification as Master and Chief Mate on ships of 500 gross tonnage or more and adopted as the “Management Level Course”.

WHEREAS, the Management Level Course has been approved by the MTC for implementation under Resolution No. 03, series of 2005.

WHEREAS, the completion of the approved education and training under paragraph 2, Regulation II/2 of the said Convention, named as the “Management Level Course”, was required under Section 28, Article VI of Board Resolution No. 02-04, the Revised Implementing Rules and Regulations (IRR) of Republic Act No. 8544.

WHEREAS, in the implementation of the approved education and training under paragraph 2, Regulation II/2 of the said Convention, named as the “Management Level Course”, an Officer in Charge of a Navigational Watch with at least six (6) months approved seagoing service may opt to either enroll and complete the Management Level Course before taking the licensure examination to prepare themselves and enhance their chances of passing, or directly take the licensure examination without enrolling and completing the Management Level Course.

WHEREAS, the Board deems it necessary to provide for the policies and guidelines in the implementation of the Management Level Course.

NOW, THEREFORE, the Board RESOLVES, as it is hereby RESOLVED, that:

1) All Chief Mates and Master Mariners who are already licensed or duly registered with the Commission are EXEMPTED from taking the Management Level Course.

2) All Officers-in-Charge of a Navigational Watch who will take the Chief Mate Licensure Examination shall be covered by this Resolution.

3 ) An Officer-in-Charge of a Navigational Watch with at least six (6) months approved seagoing service may opt to take the Management Level Course or any of its Functions prior to taking the Chief Mate Licensure Examination or directly take the licensure examination without enrolling and completing the Management Level Course.

4) The requirement for the Management Level Course shall be fully implemented on November 1, 2008.

5) An Officer in Charge of a Navigational Watch is considered:

a) PASS if he/she obtained a weighted general average rating of at least 70% in the written phase/walk-in examination of the Chief Mate licensure examination, with no rating below 60% in any subject; and

b) FAILED if he/she obtained a weighted general average rating below 70% in the written phase/walk-in examination of the Chief Mate licensure examination.

6) An Officer in Charge of a Navigational Watch who PASSED in the written phase/ walk-in examination of the Chief Mate licensure examination but FAILED in the practical examination/assessment, must re-take the practical examination/assessment and PASS, in order that he/she shall be allowed to apply for registration as Chief Mate.

7) An Officer in Charge of a Navigational Watch who PASSED the Chief Mate Licensure Examination shall present to the Board the Certificate of Completion for Function 3 of the Management Level Course from a training provider accredited by the MTC and the Certificate/Documentary proof for the required assessment in Functions 1 and 2 applying the table of equivalency approved by the MTC before he/she will be allowed to apply for the issuance of STCW ‘95 Certificates as Chief Mate.

8) An Officer in Charge of a Navigational Watch who FAILED TWICE or more in the Chief Mate Licensure Examination shall be required to take all the three (3) Functions of the Management Level Course. After passing the Chief Mate Licensure Examination, he/she shall present to the Board the Certificates of Completion for all the three (3) Functions of the Management Level Course from a training provider accredited by the MTC before he/she will be allowed to apply for the issuance of STCW ‘95 Certificate as Chief Mate.

9) The Management Level Course or any of its Functions shall only be taken once by an Officer in Charge of a Navigational Watch.

This Resolution amends Section 28, Article VI of Board Resolution No. 02-04, the Revised Implementing Rules and Regulations (IRR) of Republic Act No. 8544, in so far as to the implementation of the Management Level Course is concerned, and any previous issuance to the contrary.

Let a copy of this Resolution be furnished the U.P. Law Center and published in the Official Gazette or in a newspaper of nationwide circulation.
