[ DOTC DEPARTMENT ORDER NO. 97-1097, September 29, 1997 ]

PROVIDING STANDARD CLASSIFICATION FOR ALL PUBLIC TRANSPORT CONVEYANCE



In the interest of public service and to avoid confusion among transport service providers and commuters, a standard classification for all public transport conveyances is hereby promulgated for adoption by all agencies concerned.

The standard classification presented below shall henceforth be the basis for the issuance of Certificate of Public Convenience (CPC) for all Public Utility Vehicles (PUV).

1. Public Utility Buses

Seating Capacity:
50 and above excluding driver and conductor
Gross Veh. Weight :
6,400 kgs and above and/or 70 kgs/pax

Body Make :


Coach with entry and exit doors, emergency exits, optional separate baggage compartment and tempered glass windows
Routes:
Fixed route, regular, limited-stop or express
Ventilation :
Ordinary or Air-Conditioned
Fare:
Based on distance or zonal as authorized by LTFRB
2. Public Utility Mini-Bus
Seating Capacity :
30-49 excluding driver and conductor
Gross Veh. Weight:
Between 4,000 and 6,399 kgs. and/or 70 kgs/pax
Body Make:
Mini-coach with entry/exit door, emergency exits and optional separate baggage compartment
Routes:
Fixed routes regular, limited-stop or express
Ventilation:
Ordinary or Air-Conditioned
Fare:
Based on distance or zonal as authorized by LTFRB
3. Public Utility Jeepneys
Seating Capacity:
12-32 excluding driver
Gross Veh. Weight:
2,500 kgs. and above and/or 70 kgs/pax
Body Make:
Jitney type/AUV

Routes:

Fixed route (regular, limited-stop or express) or variable routes within a specified area as authorized
Ventilation:
Ordinary or Air-Conditioned
Fare:
Based on distance or zonal as authorized by LTFRB
Operating

Conditions:
a) May be allowed to carry passenger or freight or both for provincial operations
b) Operation is discouraged along major arterials in urban areas
c) Ceiling distance, unless authorized otherwise: Urban routes — 15 kms Inter-urban/provincial routes - 30 kms
4. Filcab

Seating Capacity :
7-11 excluding driver
Gross Veh. Weight :
Maximum of 2,500 kgs. and/or 70 kgs/pax
Body Make:
Mini-Jitney/AUV
Routes:
Fixed route (regular, limited-stop or express) or variable routes within a specified area as authorized
Ventilation:
Ordinary or Air-conditioned
Fare:
Based on distance or zonal as authorized by LTFRB
Operating
Conditions:
a) May be allowed to carry passenger or freight or both
b) Should not compete with higher-occupancy public utility vehicles on majority of the route
c) Fifteen km. ceiling distance unless authorized otherwise
5. Taxi
Vehicle Type:
Four or five door automobiles
Seating Capacity:
4 excluding driver
Route:
No fixed route within a specified area
Ventilation:
Ordinary or Air-conditioned
Fare:
Minimum rate plus fee per unit distance and unit time
Operating
Conditions:
No more than four passengers may be carried
Standard Color:
White
6. Vehicles for Hire
Vehicle Type:
Sedan, Asian Utility Vehicle, Pick-up, Van, Station Wagon or Coach
Route:
No fixed route
Fare:
Per engagement plus fee per unit time as approved by LTFRB
7. Shuttle Service
Vehicle Type :
Sedan, Asian Utility Vehicle, Pick-up, Van, Station Wagon, Mini-coach or Coach
Route:
No fixed route
Ventilation:
Ordinary or Air-Conditioned
Fare:
Based on distance or zonal as approved by LTFRB
Basis for granting

Franchise:
Valid contract between establishment or residents association and common carrie
Operating

Conditions:
Special service to employees or association members only, no picking up of passengers between designated terminal
8. Tourist Transport Services
Vehicle Type:
Sedan, Asian Utility Vehicle, Pick-up, mini-coach Coach
Routes:
Special tour trips, without fixed routes, to/from any tourist area
Ventilation:
Ordinary or Air-Conditioned
Fare:
Rates as approved by LTFRB
Operating
Conditions:
a) Accreditation by Philippine Tourism Authority (PTA)/Department of Tourism (DOT)

b) No picking of passengers along the way
9. School Transport Services


Vehicle Type:


Sedan, AUV, Van, Jitney type, Station Wagon, Mini-Coach or Coach with entry and exit doors, steel grilled windows, with black and yellow stripes at the rear
Route:
Without fixed route, to/from school premises
Ventilation:
Ordinary or Air-Conditioned
Fare:
As authorized by LTFRB
Basis for granting

Franchise:
Valid contract between school and transport provider

All public vehicles shall have uniform seating measurements, in accordance with the implementing guidelines of R.A. No. 4136 as amended and/or other relevant laws, rules and regulations.

Other rules and regulations that are inconsistent with the provisions of this Order are hereby repealed and/or modified accordingly. Public transport services with subsisting franchise that may be affected by these guidelines shall be allowed to operate until the validity of the covering CPC has expired. Henceforth, all vehicles that are subject of new franchise applications shall be covered by these guidelines.

This Order shall take effect fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation or filing of three (3) copies hereof with the U.P. Law Center, pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
