ADDENDUM TO CIRCULAR LETTER NO. 40, SERIES OF 1998-1999 RE: GUIDELINES IN THE ISSUANCE OF CERTIFICATION OF SUGAR REQUIREMENTS FOR PROCESSORS/MANUFACTURERS OF SUGAR-BASED PRODUCTS FOR EXPORT



With reference to the abovementioned subject, there is a need to include additional requirements to Circular Letter No. 40, series of 1998-1999, to effectively monitor the sugar importation of processors/manufacturers of sugar-based products vis-a-vis the sugar requirements issued by SRA to the aforementioned exporters.

SECTION 1.  Section 3 of Circular Letter No. 40, Series of 1998-1999 is hereby amended to read as follows:

"Section 3.  Application Form

An applicant shall fill out and submit to SRA the attached application for Certification of Sugar Requirements together with the following supporting documents in original form or duly certified true copy, to wit:

3.1 Industrial Technology and Development Institute (ITDI) certification on quantity of sugar used on export products

3.2 Bank Remittance/Proof of Payment

3.3 Contract between the processors/exporters and buyers/importers

3.4 Registration with the USFDA re: Bioterrorism Act (for U.S. exporter only)

3.5 Statement of Liquidation

3.6 Export Declaration

3.7 Export Sales Invoices of previous/current year

3.8 Summary of total quantity of exports for the previous/current year

3.9 Cancellation of bonds

3.10 Schedule of importation for the current year

3.11 Corporate up-to-date documents:

3.11.1  SEC Registration
3.11.2  BOI Registration
3.11.3  DTI Registration
3.11.4  BIR/VAT Registration
3.11.5  Mayor's Permit

SECTION 2. Other provisions of Circular Letter No. 40, series of 1998-1999 shall remain in full force and effect.

SECTION 3. This Order shall take effect immediately.
