[ SRA CIRCULAR LETTER NO. 25, S. 2003-2004, January 21, 2004 ]

IMPLEMENTING GUIDELINES IN THE EXPORT OF "D" OR WORLD MARKET SUGAR OF CROP YEAR 2003-2004



Pursuant to Sugar Order No. 2 as amended, Series of 2003-2004, regarding export of "D" or World Market sugar produced during the current Crop Year 2003-2004, the following guidelines are hereby promulgated for the information and guidance of all concerned, to wit:

I. Compliance of Sugar Producers - The sugar producers (planters and millers) shall manifest their compliance with the aforesaid Sugar Order, particularly in making available their "D" quedans to the exporter/s, through a Memorandum of Agreement (MOA) or Marketing Agreement (MA) between the planter's federation/millers' association and the exporter.

The said MOA/MA shall stipulate therein among others, the commitment of the producers to make availa ble their "D" quedans to the exporter in a given tranche of the shipping schedule prescribed in Sugar Order No. 2-A, series of 2003-2004.

The planters' federation and the millers' association shall furnish the SRA, for its monitoring and control, with the MOA or MA.

The subject MOA or MA shall be duly notarized.

II. Compliance of Exporters - Unless otherwise justified, the exporters of the "D" sugar to the world market shall strictly adhere to the prescribed shipping schedules of Sugar Order No. 2, as amended (Sugar Order No. 2-A), series of 2003-2004, in order to meet the rationale of the said Order.

The exporters shall, after having chartered a vessel for a given tranche, notify immediately the SRA about the vessel's expected arrival and make a request for the release of the "D" quedans from the SRA pursuant to Circular Letter No. 23, series of 2003-2004, regarding release of "D" quedans submitted to SRA for custody and safekeeping.

The exporters shall, upon receipt of the "D" quedans, apply immediately with the SRA for clearances necessary for the withdrawal and disposition of the "D" sugar in the world market.

III. Sugar Producers as Exporters - In case producer's groups are to handle the export of "D" sugar themselves, they shall be guided by Guideline No. II (compliance of exporters) hereof.

IV. Penalty - The provisions of Section 7 of Sugar Order No. 2-A, series of 2003-2004, shall apply as penalty for non-compliance in the obligatory export of "D" sugar in the world market.

V. Announcement of Opening of Allocation - The SRA shall announce through a Circular Letter the opening of allocation for the world market for each tranche on the basis of the shipment schedule prescribed in Sugar Order No. 2-A, series of 2003-2004.

This Circular Letter shall take effect immediately.
