CERTIFICATE OF COMPLIANCE TO EMISSION STANDARD (CCES)



Pursuant to Section 2, Rule XXXII of the Implementing Rules and Regulations of R.A. 8749, otherwise known as the Clean Air Act of 1999, you are hereby directed to implement the herein attached Memorandum Order of the Department of Transportation and Communications dated 04 April 2001 requiring all rebuilt and second hand imported completely built up (CBU) vehicles to present a valid Certificate of Compliance to Emission Standard (CCES) issued by DOTC prior to registration.

Effective immediately.

Memorandum

Certificate of Compliance to Emission Standard (CCES)

Pursuant to Section 2, Rule XXXII of the Implementing Rules and Regulations of R.A. 8749, otherwise known as the Philippine Clean Air Act of 1999, no rebuilt and second hand imported completely built-up (CBU) vehicles shall be allowed initial registration without the presentation of a valid Certificate of Compliance to Emission Standard (CCES) issued by this Office.

In the implementation of the CCES requirements, the following shall be observed.

1.         Rebuilt vehicles shall refer to vehicle(s) assembled in the country using either brand new or second hand engines and spare parts and to pre-registered vehicles retrofitted with brand new or second hand engines while imported second hand CBU vehicles shall refer to used/second hand vehicles imported into the country.

2.         The CCES shall be in its original form and duly signed by the authorized signatory of this Department.  Specimen of subject document is hereto forwarded for ready reference.

3.         The CCES shall be issued on the basis of a Motor Vehicle Inspection Report (MVIR) issued by any of the existing government Motor Vehicle Inspection Stations (MVIS).  The emission standard set forth in Table 18 of Section 2 Rule XXXII for rebuilt and imported second hand vehicle of the IRR of the Clean Air Act shall be followed.  The LTO inspector shall make sure that such standards are properly adhered to.

Any DOTC or LTO employee found to have allowed or caused the registration of any vehicle not in conformity with the standard referred to in item 3 of this Memorandum shall be liable to administrative sanctions and the cancellation/revocation of the Certificate of Registration (CR) of the subject vehicle.

The LTO is hereby enjoined to disseminate the information to all regional and district offices.

Compliance is herewith enjoined.
