[ SRA SUGAR ORDER NO. 5 S. 1992-93, September 17, 1992 ]

SUGAR RELEASE ORDER AND WAREHOUSE INSPECTION CERTIFICATE



Pursuant to the powers vested in the Sugar Regulatory Administration (SRA) and for the purpose of standardizing procedures in the release/withdrawal of sugar by all sugar mill companies, it is hereby ordered that:

SECTION 1. A uniform Sugar Release Order (SRO) shall be used by all sugar mill companies for the proper release/withdrawal of sugar from their warehouses.

Upon the surrender of a quedan-permit by the holder thereof on which all liens have been duly paid, an SRO shall be correspondingly issued by the mill company concerned for the release/withdrawal of the sugar covered by said quedan-permit.  Each SRO shall cover only one particular class of sugar.

If there are two or more planters’ associations/sugar cooperatives in the mill district, the mill company shall batch together under one SRO those quedan-permits pertaining to only one planters association/sugar cooperative.

SECTION 2. The SRO shall be prepared, approved and signed by the authorized representatives of the mill company and verified correct and signed by the authorized representative of the planters association/sugar cooperative concerned.  The format of said SRO is shown below for the proper adoption by the mill companies.

If, after 24 hours from presentation of the SRO to the representative of a planters association/sugar cooperative concerned the latter fails to make his verification of the correctness of the SRO, the same shall be considered a waiver of verification and an acceptance by the planters association/sugar cooperative of the correctness of the SRO as prepared and certified by the mill company representative.  Objection to the correctness of the SRO shall be made in writing.

In case of a waiver, as aforestated, the mill company shall cause the words “VERIFICATION WAIVED” to be rubber-stamped on the SRO.

Of the copies prepared, one copy thereof shall be submitted by the mill company to the Mill District Regulation Officer (MDRO) assigned thereat who will transmit same to the Production Control & Regulation Office, SRA, North Avenue, Diliman, Quezon City.  The SRA copy shall, along with the SERVED permit, be submitted together with the Sugar Delivery Report, SRA-SMS Form 705 which is sent on the Wednesday immediately following the week ending.

Where the sugar released/withdrawn is destined for tolling in a sugar refinery, two (2) additional copies of the SRO shall be furnished to the owner of the raw sugar so released/withdrawn.  Upon delivery of the raw sugar to the refinery, one (1) copy of the SRO shall be surrendered to the refinery and one (1) copy to the MDRO assigned at the refinery.

No raw sugar shall be accepted for tolling by any sugar refinery unless same is accompanied by the aforesaid SRO.

SECTION 3. In conformity with existing laws governing warehouse receipts and pursuant to SRA rules and regulations, each mill company and planters’ association/sugar cooperative concerned in their respective mill district shall jointly adopt a schedule of releases/withdrawals of sugar from mill warehouses and designating therein the hours for said releases/withdrawals.  A copy of said schedule, as certified by the mill company and the planters association/sugar cooperative concerned, shall be furnished to the MDRO assigned at the mill company.

It shall be incumbent on the authorized representatives of the mill company and the planters association/sugar cooperative concerned to be present at all times during the aforesaid designated hours and verify the accuracy of the releases/withdrawals.

SECTION 4. The mill company shall prepare a weekly certification, to be signed by its representative authorized for this purpose and the authorized representative of the planters association/sugar cooperative concerned,* that they have conducted actual inspection of the mill warehouses for purposes of verification of sugar stocks and withdrawals, said certification to be submitted along with those to be submitted to the MDRO as mentioned in Section 2, above. the format of said certification is hereto attached for the proper adoption by the mill companies.

The authorized representative so designated by the planters association/sugar cooperative concerned as required in this Sugar Order may be one and the same person whose name and specimen signatures shall be submitted by said planters association/sugar cooperative to the mill company.

SECTION 5. This Sugar Order shall take effect immediately. Provisions of sugar orders, circular letters, rules and regulations inconsistent with or contrary to this Sugar Order are hereby amended, modified or revoked accordingly.

Copies of this Sugar Order shall be furnished to all mill companies and planters associations/sugar cooperatives for their proper guidance and strict compliance.
