DISAPPROVAL OF REQUEST FOR EXEMPTION UNDER RA 7430 NOT MADE BY HEAD OF AGENCY OR OFFICE OR APPOINTING AUTHORITY



Pursuant to Section 6 of the Rules Implementing RA 7430 and CSC Resolution No. 92-1471, dated October 6, 1992, the Commission hereby adopts the policy that it shall only evaluate written requests for exemption from the requirements of the Attrition Law (RA 7430) made by the head of the agency or office or appointing authority.

Requests made by those other than the head of the agency or office or appointing authority shall be denied outright.

Please be guided accordingly.

RESOLUTION NO. 92-1471

WHEREAS, under Republic Act No. 7430, no appointment shall be made to fill up vacated positions in any government office within five (5) years from the approval of the Act except in instances enumerated therein;

WHEREAS, numerous requests are received by the Civil Service Commission for exemption from the requirements of Republic Act 7430 by officers other than the heads of offices or agencies;

WHEREAS, under Section 6 of the Rules Implementing Republic Act No. 7430, the Civil Service Commission may grant authorization to fill up positions exempted under Section 4 (a), (b), (c), (d), (e), and (j) of said Rules upon written request of the head of the agency or office and submission of appropriate documents to establish the actual existence of the ground or grounds for the grant of exemption.

WHEREFORE, the Commission hereby resolves to evaluate only written requests made by the head of the agency or office or the appointing authority.

The Commission shall deny requests made by those other than head or agency or office or appointing authority.
