[ LTFRB MEMORANDUM CIRCULAR NO. 97-011, November 14, 1997 ]

FILCAB SERVICE ROUTES



In line with the DOTC Dept. Order No. 97-1097, providing standard classification for all public transport conveyances, and for the information and guidance of all concerned, the operation of "FILCAB" services is hereby categorized as follows, to wit:
CLASSIFICATION
CHARACTERISTICS
RESTRICTIONS
1. Fixed route-regular
-Like PUJ route
-Confined to route

-Fares regulated
-must have terminals on both ends.
2. Fixed route-limited
-Point to point with limited stops for loading/unloading
-Shall not pass thru major arterial roads

-Fares regulated
-must have terminals on both ends
3. Express Service
-Point to point with no loading/unloading in-between.
-May pass thru major arterial roads but no pick & drop in between
-Fares regulated.
-must have terminals on both ends
4. Zonal
-Route not fixed but within a specified area or zone
-Shall not operate outside the specified area.

-Fares regulated
-must have terminal within the specified area or zone.

In the meantime, however, in view of the present moratorium on the acceptance of new applications for franchises to operate public utility vehicles as imposed under Memorandum Circulars No. 97-009 and 97-009-A, only petitions for amendment of existing Certificates of Public Convenience will be accepted for consideration, without payment of filing fees. the validity of the amended CPC shall be the same as its original expiry date.

The petitions should invariably include the following documentary requirements:
1.    Copy of Decision (CPC);
2.    Latest CR/OR of the unit/s involved;
3.    Proposed classification/route preferred;
4.    Sketch and location of terminals on both ends; and
5.    Proposed fare.
Operators shall paint the service type classification they have chosen on both sides of the unit, indicating the points of origin and destination or route description, in bold letters 5 inches in height, 1 inch in width and 1/2 inch space between letters. The color of the letterings shall be in contrast to the background color of the unit’s panel.

Violation of the operation characteristics and route restrictions hereinabove defined, after issuance of the franchise for Filcab Service, shall be subject to the following fines/penalties:
Driver
1. First Offense
P500.00 and one (1) week suspension of driver’s license
2. Second Offense
P1,000.00 and one (1) month Suspension of the driver’s license
3. Third Offense
Revocation of the driver’s license

Operator
1. First Offense
P3,000.00 and one (1) week Suspension of the unit’s CPC
2. Second Offense
P6,000.00 and one (1) month suspension of the unit’s CPC
3. Third Offense
Revocation of the unit’s CPC

This Memorandum Circular shall take effect fifteen (15) days after the filing of three (3) copies hereof with the U.P. Law Center, in accordance with Presidential Memorandum Circular No. 11, dated October 9, 1992.
