SANCTIONS FOR NON-SUBMISSION OF PDOS REPORT/S AND NON-COMPLIANCE WITH THE GUIDELINES IN THE ACCOMPLISHMENT OF THE PDOS REPORT FORM



It has been noted that Section 8, Rule III, Book VIII of the POEA Rules, as Amended has remained as the most commonly violated rule on pre-departure orientation seminar (PDOS).  Despite the official PDOS report form and guidelines in accomplishing same, issued through Memo Circular No. 22, Series of 1991, incidence of violations of said rules has continued to increases.

In view thereof and in order to ensure the validity and credibility of the PDOS report as one of the instruments of monitoring compliance with the requirement of providing the worker/s PDOS before deployment, the POEA deems it proper to:

1. Reiterate that the penalty for failure to file the report as prescribed or may be prescribed by the POEA, is suspension of documentary processing until compliance, pursuant to the Revised Schedule of Penalties; and

2. Consider failure to conform with the prescribed guidelines in accomplishing the official PDOS report form as failure to file same which shall render the agency/entity concerned liable for the same penalty as stated above.

The Memorandum Circular shall take effect immediately.
