DELEGATION OF AUTHORITY TO REGIONAL DIRECTORS TO ISSUE DEPUTATION ORDERS, AND FOR REGIONAL OFFICES TO PERFORM ADJUDICATION FUNCTIONS



Whereas the law enforcement and adjudication functions of the Office are performed nationwide and Regional Directors are accountable to the Sectoral Office for the performance of their respective regions on matters of law enforcement in the implementation of its basic mandates as well as for revenue generation.

In view thereof, as required by the need to complement responsibility with authority, and in consonance with the LTO's functions, organizational set-up and corollary measures adopted as necessary to achieve its tasks and assigned performance target, the undersigned, pursuant to Section 4 (d), (4), Article III and other pertinent provisions of R.A. 4136, related laws, rules and regulations, do hereby delegate to Regional Directors the authority to deputize qualified persons to enforce the provisions of Republic Act 4136 and other related laws enforced by the LTO, and correspondingly to suspend or revoke the same.

Corollary thereto, Regional Offices, thru their respective Regional Directors, are accorded the authority to adjudicate apprehension cases effected in their respective areas of jurisdiction, subject to compliance with the provisions of Executive Order No. 266 and related rules and regulations.

This Memorandum Circular takes effect immediately and all orders and memoranda in conflict therewith are deemed revoked, superseded, or modified accordingly.
