AMENDMENTS TO CMO 8-2004 (SHIPMENTS SUBJECT TO MANDATORY MAGNA SCALE WEIGHING PRIOR TO RELEASE FROM CUSTOMS CUSTODY



To promote a better alignment of functions between operations vis-a-vis assessment and to ensure close monitoring of shipments relative to the above-captioned subject, Section 4.2 and 4.3 of CMO 8-2004 are hereby amended to read as follows:

"4.2 For shipments subject to mandatory magna scale weighing, the Chief, Section 1, Formal Entry Division (FED) shall assign a representative from the Pier Inspection Division (PID) to personally witness the weigh-in, which shall be conducted b y the weighing company and who shall furnish the PID representative with a copy of the weighing ticket.  The PID Chief shall thereafter transmit to the Formal Entry Division (FED) a daily report on the result of the magna scale weighing based on the weighing ticket/s received, copy furnished the Deputy Commissioner for AOCG, the Deputy Collector for Operations, and the Deputy Collector for Assessment.  Should a discrepancy be noted, the FED shall recomputed the taxes/duties due on the shipment.

4.3 Should the required action be the payment of additional taxes and duties, the FED shall refer the matter for appropriate action to the Cash Division."

All Orders, Memoranda, Circulars, or parts thereof which are inconsistent with this Order are hereby deemed revoked, amended or modified accordingly.

This Order shall take effect immediately.
