SUSPENDING THE ISSUANCE OF PERMITS FOR NEW INSTALLATION/PROJECTS OF ALL POWER AND COMMUNICATION COMPANIES IN METRO MANILA



WHEREAS, it has been the practice of power and communication companies to install several poles/posts in one area without considering the safety and convenience of the public and the damage that it could pose to the environment;

WHEREAS, the ugly and unsafe dangling power and communication wires and cables and the leaning, rotten and redundant poles installed by these companies greatly contributed to the blight and clutters in our environment;

WHEREAS, despite the government’s and the public’s call for action to these utility companies to correct and improve the poor result of their works, these companies did nothing to respond to the said call and continuously disregarded the code of standard practice for this application;

WHEREAS, while the government is spending much on projects geared to improve the facelift every dilapidated façade of Metro Manila, these companies flaunt their projects, unmindful of the government’s effort as they continue and enjoy earning unprecedented revenues;

WHEREAS, in order to ensure public safety and convenience and to avoid further increase of similar urban blight and clutters, there is an urgent need to suspend the issuance of permits to all public utility companies applying to install/construct new projects so they can put all their resources to address this problem seriously with haste;

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that the Council hereby suspends the issuance of permit for new installation/projects of all power and communication companies in Metro Manila and hereby urges the LGUs to do the same until substantial improvement has been effected to the satisfaction of the Council and the general public.

RESOLVED FURTHER, that the suspension on the issuance of permit shall only be lifted pending compliance with the following conditions:

SECTION 1. Conditions for Permit - The permit to install power and communication wires/cables or any other activity to be done by the utility companies shall contain among other things, such safety measures as may be necessary to ensure public safety and convenience.

SECTION 2. In all instances, permit shall only be issued for underground wire installation. However, if this is not feasible due to the high cost involved therein, the following conditions must be followed:

a. All power and communication wires and cables shall be properly strung with required minimum ground clearance and bundled with a minimum slack;

b. The utility company owner must replace all dilapidated posts/poles and repair or fix all posts/poles that are out of plumb.

c. Remove all redundant poles, (One pole per location only)

SECTION 3.    For excavation/diggings to be undertaken, the provisions of MMA Ordinance No. 2, Series of 1991 and MMDA Regulation 98-009, Series of 1998, attached hereto as Annexes A* & B*, shall be strictly followed.

RESOLVED FINALLY, that no LGU shall issue/grant permit to any public utility company with new projects including relocation, renovation and rehabilitation works, either local or national, without clearance from the MMDA.

This Resolution shall take effect May 15, 2007.
