[ MMDA RESOLUTION NO. 07-10, March 22, 2007 ]
SUSPENDING THE ISSUANCE OF PERMITS ON DIGGINGS AND EXCAVATIONS ALONG EPIFANIO DELOS SANTOS AVENUE (EDSA), METRO MANILA
WHEREAS, the number of motor vehicles passing through Epifanio delos Santos Avenue continue to increase annually without the corresponding increase in road space along said thoroughfare due to an inherent limitation;
WHEREAS, it has been observed that the numerous diggings and excavations being undertaken by public and private utility companies greatly contributed to the traffic congestion along EDSA at any time of the day whenever such construction is undertaken;
WHEREAS, these diggings/excavations not only cause disturbance during construction and affect the smooth flow of traffic but also require costly and unbearable maintenance on the part of the government;
WHEREAS, such resulting inconvenience and congestion further results to counter-productivity for the majority of inhabitants and guests of Metro Manila;
WHEREAS, there is an urgent need to address the aforesaid problem by adopting measures that will minimize the traffic congestion thereat for the benefit of the motorists and commuters;
WHEREAS, RA 7924 mandates MMDA to formulate, coordinate and monitor policies, standards, programs and projects involving transport and traffic management to rationalize the existing transport operations, infrastructure requirements, the use of thoroughfares, and promotions of safe and convenient movement of persons and goods in Metro Manila;
WHEREAS, the Metro Manila Council, in session duly assembled, after due deliberation recognized the need to immediately address the traffic congestion in EDSA, it being one of the major thoroughfares of Metro Manila, by regulating diggings/excavations thereat.
NOW, THEREFORE, be it resolved, as it hereby resolved, pursuant to Section 6 of RA 7924, that the Council hereby suspends the issuance of permits on diggings/ excavations along Epifanio delos Santos Avenue (EDSA), Metro Manila, to minimize traffic congestion in the aforesaid area.
RESOLVED FURTHER, that all diggings and excavations including all other activities/works that will pass throughout the stretch of EDSA shall be suspended, except those related with emergency repairs or those that would entail crossing said thoroughfare.
RESOLVED FINALLY, that this resolution shall cover all utility companies such as, power, communication and water companies.
This Resolution takes effect upon approval.
