[ MMDA RESOLUTION NO. 07-09, March 22, 2007 ]

REQUIRING ALL PRIVATE AND PUBLIC ENTITIES TO SECURE CLEARANCE FROM MMDA ON PROJECTS/ACTIVITIES THAT WOULD AFFECT THE DESIGN AND CONSTRUCTION OF METRO MANILA ROADWAYS FOR MONITORING AND CONTROL PURPOSES



WHEREAS, the MMDA has been undertaking traffic engineering responsibilities through its Traffic Engineering Center since 2003 when it was transferred from the DPWH during the time that MMDA Chairman Bayani F. Fernando held the position of Acting Secretary of Public Works and Highways in concurrent capacity;

WHEREAS, in a Memorandum dated May 06, 2003, “Placing The DPWH-NCR Under The Functional Control of MMDA”, President Gloria Macapagal – Arroyo instructed the MMDA Chairman to assume functional control over the NCR branch of the DPWH to ensure the implementation of one master infrastructure program;

WHEREAS, among the traffic engineering responsibilities of the Authority are to ensure that the design and construction of Metro Manila roadways are harmonized and safe for the motorists, commuters and pedestrians and to ease the flow of traffic and attain or maintain the desirable optimum speed for vehicles;

WHEREAS, it has been noted that there are projects and activities being implemented by public and private entities that have affected the design and construction of Metro Manila roadways thereby undermining the elements of road safety and traffic efficiency;

WHEREAS, there is a need to harmonize, coordinate and assure compliance to standards of safety to life and property, save on cost of maintenance, and to familiarize and educate road users to such traffic engineering standards to ensure road safety on the streets and maintain smooth and efficient traffic flow in Metro Manila;

WHEREAS, RA 7924 mandates MMDA to administer and implement all traffic enforcement operations, traffic engineering services and traffic education programs, including the institution of a single ticketing system in Metropolitan Manila;

WHEREAS, the Metro Manila Council recognized the need to regulate all projects and activities being implemented by both private and public entities particularly those that would affect the design and construction of Metro Manila roadways.

NOW, THEREFORE, be it resolved as it is hereby resolved, pursuant to Section 6 of RA 7924, that the Metro Manila Council hereby requires all public and private entities to secure clearance from MMDA before implementing any project/activity that would affect the design and construction standards of Metro Manila roadways, such as but not limited to the following, for monitoring and control purposes:

  1. Installation and removal of streetlights;
  2. Lane Markings;
  3. Installation and removal of traffic signs;
  4. Installation and removal of bollards;
  5. Planting of trees along the sidewalks; and
  6. All other constructions to be undertaken on the road

RESOLVED FINALLY, that all private and public entities including DPWH  are hereby required to secure clearance from MMDA involving road construction, diggings and excavations and/or any design to be done along Metro Manila roadways.

Let copies of this Resolution be furnished to the LGUs of Metro Manila.

This Resolution takes effect upon approval.
