[ SRA SUGAR ORDER NO. 10, April 21, 1999 ]

AMENDMENT OF CERTAIN PROVISIONS OF SUGAR ORDER NO. 8, SERIES OF 1995-1996 RE: RULES AND REGULATIONS ON SUGAR IMPORTED BY MANUFACTURERS OF SUGAR-BASED PRODUCTS FOR EXPORT



WHEREAS, it is in the national interest to amend certain provisions of Sugar Order No. 8, Series of 1995-1996, in order to sustain the competitiveness in the world market of our processors/manufacturers of sugar-based products for export and to effectively monitor the sugar imported by the aforesaid processors/manufacturers;

SECTION 1. Section 2 of Sugar Order No. 8, Series of 1995-1996 is hereby amended to read as follows:
"Section 2. The importer-consignee of the imported sugar covered by this Order shall apply for clearance with the SRA prior to the release of the commodity by the Bureau of Customs (BOC) by submitting the following pertinent documents, to wit:

a. Certification of Sugar Requirements of Processors/Manufacturers of Sugar-Based Products for Export, for a given year, issued by the SRA

b. Pro-Forma Invoice

c. Bill of Lading

provided that, the importer/consignee who is an accredited member of the Customs Common Bonded Warehouse (CBW) is exempted from submitting the Certification of Sugar Requirement and shall only be required to submit an approved import quota issued by the BOC.

Likewise, the said bonded importer/consignee may apply for clearance with the SRA prior to the arrival of the sugar shipment, provided that the pertinent import documents, duly certified by the CBW in which the importer/consignee is a member, are submitted to SRA as requirements for issuance of the SRA clearance.

For effective monitoring, all bonded importers/consignees with SRA clearances shall furnish SRA a copy of the liquidation report submitted to BOC within nine (9) months from the date of issuance of the clearance.
SECTION 2. Section 3 of Sugar Order No. 8, Series of 1995-1996, is hereby amended to read as follows:
"Section 3. The importer/consignee shall pay a monitoring fee of P5.00 per LKg/Bag of imported sugar directly to the SRA prior to issuance of clearance."
SECTION 3. This Sugar Order shall take effect immediately.

SECTION 4. Other provisions of Sugar Order No. 8, Series of 1995-1996 shall remain in full force and effect.

SECTION 5. Provisions of Sugar Orders, Circular Letters, Rules and Regulations inconsistent with or contrary to this Sugar Order are hereby revoked, amended or modified accordingly.
