[ DOTC DEPARTMENT ORDER NO. 2004-24, April 27, 2004 ]

AMENDING DEPARTMENT ORDER NO. 97-1097, DATED 29 SEPTEMBER 1997 (PROVIDING STANDARD CLASSIFICATION FOR PUBLIC TRANSPORT CONVEYANCES) RECLASSIFYING TOURIST TRANSPORT SERVICE



Acting on the recommendation of the Land Transportation Franchising and Regulatory Board (LTFRB), the Department hereby APPROVES to modify Paragraph 8 of Department Order 97-1097, dated 29 September 1997, which now reads:

For Tourist Coupon Transport Service

Tourist Coupon Transport Service shall refer to four-door sedan vehicles, vans (such as Mitsubishi L-200, Nissan Urvan, Toyota Hi-Ace, Hyundai Starex, Kia Besta, Kia Pregio, MB 100 or their equivalent), and Asian Utility Vehicles (AUV) plying the international and/or domestic airports, seaports, and hotels.  Backseats of AUVs with liftbacks shall be removed.  They shall have body markings and no top light shall be installed.

Upon contracting the services of the Tourist Coupon Transport Service, passengers must be given an Official Receipt/coupon containing the following information:

a. Name of Passenger
b. Name of Operator/Business Name
c. Address of Operator
d. Date Hired
e. Point of Origin and Destination
f. Number of Passengers
g. Number of Luggage
h. Name of Driver
i. Plate Number
j. Amount Paid

:

Without fixed route
Ventilation : Air-conditioned

Fare

: To be approved by LTFRB

Basis for Granting Franchise :

Compliance with all the requirements prescribed by LTFRB

Operation

: Application for CPC Endorsed by the Department of Tourism (DOT)
 : Accreditation by DOT after CPC is granted
  

No Picking-up of passengers on return trip


The passenger shall sign the Original Receipt or coupon upon reaching his/her destination to confirm satisfaction of service.

For Tourist Chartered Transport Service

Tourist Chartered Transport Service shall refer to coasters, vans (such as but not limited to Mitsubishi L-300, Nissan Urvan, Toyota Hi-Ace, Hyundai Starex, Kia Besta, Kia Pregio, MB 100 or their equivalent), air-conditioned jeepneys, mini-buses and buses. Services must be covered by a Contract of Service. Vehicles must have body markings (trade name, plate number and LTFRB case number).

For Tourist Rent-a-Car Transport Service

Tourist Rent-a-Car Transport Service shall refer to four-door sedan vehicles, pick-up, limousines (defined as a vehicle provided with plush carpeting, luxurious upholstery and premium sound system with engine displacement of not less than 2000 cc and has a wheel base of a minimum of 2670 mm), Sports Utility Vehicles (SUV), and vans.  Vehicles must have no body markings.

Basis for Granting Franchise : Compliance with all the requirements prescribed by LTFRB

Operation :

 Application for CPC Endorsed by the Department of Tourism (DOT)
 : Accreditation by DOT after CPC is granted
  May be hired with driver or without driver
  
Accordingly, the LTFRB is hereby directed to formulate guidelines for the implementation of this Department Order.

This Amendment shall take effect after fifteen (15) days following its publication in at least two newspapers of general circulation and filing with the University of the Philippines Law Center.
