(NAR) VOL. 10 NO. 3 / JULY - SEPTEMBER 1999

[ ATO DEPARTMENT ORDER NO. 98-1178, September 03, 1998 ]

AN ORDER REVISING CERTAIN FEES AND CHARGES OF THE AIR TRANSPORTATION OFFICE (ATO) FOR ALTERNATE INTERNATIONAL AIRPORTS AND NATIONAL AIRPORTS (D.O. NO. 94-763)



In compliance with Executive Order No. 159 dated 23 February 1994, as implemented by Department of Finance and Department of Budget and Management Joint Circular No. 2-94 dated 14 December 1994, directing revision of fees and charges at just and reasonable rates to recover full cost of services rendered, Parts III, IV and V of Department Order No. 94-763 are accordingly amended as follows:

LANDING FEES

The entire provision of PART III, Sections 1 to 4 of D.O. No. 94-763, are hereby amended to read as follows:
“Sec. 1. Landing Fees for International Flights at Alternate International Airports — Landing fee shall be P100.00 per 1,000 kgs. gross weight or a fraction thereof up to 160,000 kgs. and P80.00 for every 1,000 kgs. or a fraction thereof in excess of 160,000 kgs.”

“Sec. 2. Landing Fees for Domestic Flights at Alternate International Airports — Landing fee for domestic flights at alternate international airports shall be P70.00 per 1,000 kgs. gross weight or a fraction thereof up to 160,000 kgs. and P50.00 for every 1,000 kgs. or a fraction thereof in excess of 160,000 kgs.”

“Sec. 3 Landing Fees for Domestic Flight at Other National Airports — Landing fees for domestic flights at other national airports hereunder prescribed shall cover landing and take-off as follows:

A) For airports with portland cement concrete paved runway, the fee shall be P55.00 per 1,000 kgs.

B) For airports with asphaltic concrete macadam paved runway, the fee shall be P45.00 per 1,000 kgs.”

“Sec. 4. Night Landing Fees — At airports with night landing facilities an additional charge of fifteen percent (15%) of the corresponding charges prescribed under Section 3 hereof, shall be imposed on all commercial aircrafts landing and taking-off between 6:00 p.m. to 6:00 a.m. (local time). This additional charge shall be reduced to ten percent (10%) if:

A) The landing was made before nighttime and the subsequent take-off was made during nighttime; or

B) The landing was made during nighttime and the subsequent take-off was made during daylight hours.”
PARKING CHARGES

The entire provisions of PART IV Sections 1 to 2 of the same Order, are hereby amended to read as follows:
“Sec. 1. Fees for Parking at the Terminal Apron — Parking at the terminal apron for the first hour for jet aircrafts, and for the first forty five (45) minutes for jet-prop aircrafts shall be free of charge. An additional fee of ten percent (10%) of the landing fees prescribed in Part III hereof will be charged for every additional fifteen (15) minutes.”

“Sec. 2. Fees for Other Parking Spaces — Fees for the use of designated parking spaces shall be levied on the basis of hourly rates in accordance with the following schedules.

A) Paved parking areas: A charge of P10.00 per 5,000 kg. gross weight per hour or a fraction thereof.

B) Unpaved parking areas: A charge of P5.00 per 5,000 kgs. gross weight per hour or a fraction thereof.”
PASSENGER SERVICE CHARGE

Section 1 of PART V of the same Order is likewise amended to read as follows:
“Sec. 1. Passenger Service Charge — A passenger service charge shall be paid by each departing passenger, except transit passengers, children two (2) years of age and below, and ATO and DOTC central office employees, in accordance with the following rates:

A) At Alternate International Airports

1. International Passenger — P500.00

2. Domestic Passenger — P40.00

B) At Trunkline Airports

Each Passenger — P30.00

C) At Secondary Airports

Each Passenger — P20.00

D) At Feeder Airports

Each Passenger — P10.00"

REPEALING CLAUSE

All previous administrative orders, rules and regulations, or part thereof, inconsistent with or contrary to any provision of this order are hereby repealed or modified accordingly.

EFFECTIVITY DATE

This Order shall be published once a week for two (2) consecutive weeks in two (2) newspapers of general circulation in the Philippines and the same shall be effective fifteen (15) days after the last publication.
