MODIFICATION TO MC 2004-043



It has been observed by this Board that filing of Applications for Exemption pursuant to MC 2004-043 has been abused by those registered owners/operators of private vehicles classified as Truck, Aluminum Van or called by other names or has another configuration, by applying for an exemption despite operating as for hire and with consideration.

Thus, this Board hereby amends and modifies MC 2004-043 dated December 13, 2004, by excluding therein the filing of Application for Exemption for the Operation of TH Services.

All issuances inconsistent herewith are hereby superseded and amended accordingly.

This Memorandum Circular shall take effect fifteen (15) days following its publication in a newspaper of general circulation and filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 9 October 1992.
