[ PPA MEMORANDUM ORDER NO. 10-96, September 10, 1996 ]

AUTHORITY TO DIVERT SHIPMENTS INTENDED TO BE HANDLED BY PORTA VAGA PORT SERVICES, INC. (PORTA VAGA FOR BREVITY) AT NAVOTAS FISHING PORT COMPLEX (NFPC)



By virtue of the Temporary Permit to Operate Cargo Handling Services issued by this Office to Porta Vaga, dated 06 June 1996, and in keeping with the spirit of the Memorandum of Agreement between PPA and the Philippine Fisheries Development Authority (PFDA), vessels carrying commercial cargoes authorized by the Bureau of Customs to be brought to NFPC and those that may be diverted thereto by reason of port/berth congestion at any PPA-administered ports or for reasons of public interest and welfare should be authorized to proceed to said fishport subject to the following conditions:

1. That vessel carrying commercial cargoes is in possession of a PPA authority to proceed to NFPC issued by the PPA Port Manager in accordance with the attached form.

2. That income from such cargoes which are intended to be handled by Porta Vaga at any operational berth at the Pasig River but was diverted to NFPC shall be subject to 12% government share presently being paid by APSI.

3. That subject cargo handler is in possession of an appropriate service contract with the vessel company and/or cargo owner/consignee.

4. That Porta Vaga shall not service/handle such cargoes until it has in its possession a true copy of official receipts evidencing full payment of wharfage dues collected by PPA.

5. That the vessel laden with such cargoes has been paid corresponding vessel charges as shown by official receipts of PPA.

6. That Porta Vaga shall turn-over copies of such receipts to the Office of the TMO Pasig every end of the month and during the period that this authority is effective.

7. That this authority shall be without prejudice to the company's compliance with its other obligations prescribed in its Temporary Permit, dated 06 June 1996, and that same shall be effective only up to the time that its regular permit is issued.

8. That this authority may be cancelled earlier by this Office for reasons consistent with existing PPA regulations or when PFDA earlier terminates the company's permit to operate at NFPC.

For this purpose, the PDO Manila through PMO North Harbor and South Harbor is directed to monitor the cargo handling operations of Porta Vaga at NFPC.
