[ NTC MEMORANDUM CIRCULAR NO. 04-05-2004, May 14, 2004 ]

FREQUENCY BAND ALLOCATION 14-14.5 GHZ FOR AERONAUTICAL MOBILE SATELLITE SERVICE ON SECONDARY BASIS



Whereas, pursuant to Rule 600 of MC 8-9-95, Implementing Rules and Regulations on RA 7925, the radio spectrum allocation and assignment shall be subject to review in the interest of public service and in order to keep pace with the development in the wireless technology;

Whereas, the Commission is mandated to promote and sustain a healthy and competitive telecommunications environment;

Whereas, pursuant to RA 7925, the growth and development of telecommunications services is to be pursued.

Wherefore, in the interest of service, the National Telecommunications Commission, pursuant to RA 7925 and its Implementing Rules and Regulations, EO 546 series of 1979 and Act No. 3846, as amended, and in accordance with the ITU frequency allocations, hereby allocates the frequency band 14 - 14.5 GHz for the Aeronautical Mobile Satellite service on Secondary basis, subject to national and international regulations to include ITU RR nos. 5.29, 5.30 and 5.31 among others, and shall form part of the National Radio Frequency Allocation Table.

Stations of a secondary service shall not cause harmful interference to stations of primary service to which frequencies are already assigned or to which frequencies maybe assigned at a later date (no.5.29); that they can not claim protection from harmful interference from stations of primary service to which frequencies are already assigned or to which frequencies maybe assigned at a later date (no.5.30); but can claim protection however, from harmful interference from stations of the same or other secondary service(s) to which frequencies maybe assigned at a later date (no.5.31).

This circular shall take effect fifteen days after publication in a newspaper of general circulation and three (3) copies furnished the UP Law Center.

Any Circular, Order or Memorandum inconsistent herewith is deemed superseded.
