[ BAI MEMORANDUM ORDER NO. 11, S. 2005, July 18, 2005 ]

RULES AND REGULATIONS PROHIBITING IMPORTATION OF FMD-SUSCEPTIBLE ANIMALS, THEIR PRODUCTS AND BY-PRODUCTS, FRESH FROZEN PRODUCTS ORIGINATING FROM THE PEOPLE'S REPUBLIC OF CHINA AND HONGKONG, SPECIAL ADMINISTRATIVE REGION OF THE PEOPLE'S REPUBLIC OF CHINA



WHEREAS, reports submitted by the Agriculture, Fisheries and Conservation Department (AFCD), Hongkong and the Ministry of Agriculture, Beijing to the Office International des Epizooties last March 23, 2005 and May 13, 2005, respectively, confirmed the outbreaks of Foot and Mouth Disease (FMD);

WHEREAS, the outbreak of FMD type Asia 1 was reported in Sheung Shui, New Territories in Hongkong Special Administrative Region of the People's Republic of China and two outbreaks of FMD type Asia 1 were reported in Jiangu and Shandong Provinces of the People's Republic of China;

WHEREAS, no importation of FMD-susceptible animals, their products and by-products, and fresh frozen products originating from China and Hongkong was allowed thereby preventing the entry of FMD in the country;

WHEREAS, there are no accredited plants in China and Hongkong to export FMD-susceptible animals, their products and by-products, and fresh frozen products;

WHEREAS, the fresh frozen meat products from Hongkong and China are illegal and are not allowed to enter the country;

NOW, THEREFORE, I, DOMINGO F. PANGANIBAN, Secretary of Agriculture, by the powers vested in me by law, do hereby institute the following emergency measures:

    1. Only canned, cooked, processed meat products coming from accredited meat processing plants are allowed to be imported;

    2. All shipment of canned meat products must be certified by the China Commodity Inspection Bureau (CCIB);

    3. Only original pro-forma invoices issued by the accredited processing plants and authenticated by both the Department of Foreign Affairs of the People's Republic of China and the Philippine Consulate in Beijing shall be valid as supporting document for the Veterinary Quarantine Clearance (VQC) application;

    4. Canned meat products from accredited processing plants should be registered with the Bureau of Food and Drugs (BFAD) of the Department of Health (DOH);

    5. The validity of shelf-life of the canned meat products is no less than 18-24 months from date of manufacture. Date of manufacture should also be indicated;

    6. The canned meat products should be labeled "For export to the Philippines";

    7. The processed meat products are packed in cans embossed with the company patent code of the accredited processing plant;

This Order shall take effect immediately.
