[ DBM BUDGET CIRCULAR NO. 5-A, December 16, 1994 ]

GRANT OF YEAR-END BENEFITS FOR CY 1994



1. Purpose - This Circular is issued to clarify the meaning of "pending cases" in Budget Circular No. 5, dated October 14, 1994, as one of the bases for the disqualification of government personnel from receiving the CY 1994 year-end benefits.

2. For purposes of the grant of said year-end benefits, government personnel shall be construed as having a "pending case" under the following instances:

2.1
When under preventive suspension, until exonerated;
 
2.2
When formally charged in administrative cases, i.e., their offices have found, after a preliminary investigation, that a prima facie case exists against them and the requisite written formal charge has been issued by the disciplining authority;
 
2.3
When they have cases pending before the Office of the Ombudsman or the Prosecutor's Office or other administrative bodies which relate to acts or omissions in connection with their official duties or functions and where it has already been resolved by the Offices concerned that there exists prima facie cases; and
 
2.4
When there is a pending criminal information filed against them in the Courts which relates to acts or omission in connection with their official duties and functions.

3. This Circular shall take effect immediately.
