[ PRC BOARD RESOLUTION NO. 58, January 24, 1990 ]

WHEREAS, PURSUANT TO SECTION 14 OF REPUBLIC ACT NO. 2644, KNOWN AS THE PHILIPPINE MIDWIFERY LAW



WHEREAS, pursuant to Section 14 of Republic Act No. 2644, known as the Philippine Midwifery Law, it is provided that, in order to be admitted to the midwifery licensure, an applicant must, at the time of filing his/her application, establish to the satisfaction of the Board that he/she: "x x x b) is at least twenty one (21) years of age x x x;"

The Board observed that many applicants in the midwifery examination who have not reached the age of twenty one (21), were conditionally admitted to the examination pursuant to a policy approved by the Commission; However, those who passed the examination will not be allowed to register as Midwives until they reach the age of twenty one (21), in which case their Birth Certificates will be submitted in evidence to determine that they have reached the age of twenty one (21) years on the date of their registration;

WHEREAS, the Board also observed that some applicants wrote erroneous dates of birth implying that they have reached the age of twenty one (21) years, when in fact not.  After the release of the examination they were able to register and were issued license to practice midwifery.  In due time, the erroneous dates of birth indicated by the applicant in their applications were discovered after their registration because the Birth Certificates are required by their employer abroad or local.  In view of this discrepancy in their dates of birth, the applicants now come to this Office for the correction of their records only to be discovered that they were registered and licensed to practice midwifery due to the erroneous dates of birth they have used in their applications or registrations.  On the basis of the law, Midwives who have registered based on erroneous dates of birth, have practiced midwifery illegally.  The Board, therefore, requires that all applicants in the future midwifery examination, must present, a certified copy of their birth records to determine the correct dates of birth written in their applications or in the registration records.

NOW, THEREFORE, the Board, Resolved, as it hereby resolves, that all applicants to the midwifery licensure examination be required to present a certified copy of their Birth Records or Birth Certificates to determine their correct dates of birth.  That those who have been registered due to the erroneous dates of birth given by the applicants be forwarded to the Legal and Investigation Division for appropriate action.

FURTHERMORE, after approval of this Resolution by the Commission, the same shall be disseminated to all schools/colleges/universities offering the course in Midwifery for their information and guidance.
