[ NTC MEMORANDUM CIRCULAR NO. 19-12-2000, December 12, 2000 ]

REVISED SCHEDULE OF, INCLUDING ADDITIONAL, ADMINISTRATIVE FEES AND CHARGES OF THE NATIONAL TELECOMMUNICATIONS COMMISSION



In compliance with Executive Order 197, dated January 13, 2000, directing all government agencies and government-owned or controlled corporations, to increase their rates of fees and charges by not less than twenty percent (20%) and Executive Order 218 providing further guidelines thereof, as implemented by DOF-DBM Joint Circular No. 2000-2 of the Department of Finance and the Department of Budget and Management dated April 4, 2000 and pursuant to Executive Order No. 546, the following revised schedule of administrative fees and charges including additional fees and charges, respectively, of the National Telecommunications Commission is hereby approved for implementation:

SECTION 1. General Provisions —

1. Power as appearing in this circular shall mean:
a. For AM broadcast stations in the broadcasting service, the authorized power shall be the output of the transmitter.

b. For FM and TV stations in the broadcasting service, the authorized power shall be the effective radiated power (erp) of the station.

c. For Fixed, Land Mobile, Maritime, Aeronautical, and Space Services, the authorized power shall be the effective radiated power of the station (except microwave stations)

2. Effective radiated power refers to the product of the power supplied to the antenna and its gain relative to a half-wave dipole, less antenna transmission loss.

3. Broadcasting stations shall refer to AM, FM, TV and Translator broadcasting stations. For the fees and charges of Auxilliary Broadcast Transmission services such as studio-to-transmitter link (STL), BC remote-pick-up, BC communication, coordination and control stations used in connection with the operation of broadcasting stations, the fees and charges of the Fixed and Land Mobile services shall apply.

4. For the Citizens Band radio service, the fees and charges of the Fixed and Land Mobile services shall apply.

5. Every station on full duplex narrow band mode other than the repeater station shall be charged a license fee twice as much as the simplex mode station.

6. For any change in the particulars of the radio station which shall cause modification to its station license, the Construction Permit fee corresponding to its radio service shall be charged.

SECTION 3. Repealing Clause —

a. All other fees and charges as provided in existing circulars, orders and rules and regulations not herein revised shall continue to be observed and implemented.

b. Any and all memoranda, circulars and other administrative issuances in conflict with this Circular are deemed amended, superseded and or repealed accordingly.

SECTION 4. Separability Clause — Any portion or section of these rules which may be declared invalid or unconstitutional shall not affect the validity of the other remaining portions or sections.

SECTION 5. Effectivity — The new and revised rates as herein prescribed shall be published once in a newspaper of general circulation in the Philippines and shall take effect fifteen days after its publication, and three certified copies furnished the UP Law Center.
