[ SRA MEMORANDUM CIRCULAR NO. 1, October 16, 1998 ]

CLARIFICATION ON THE APPLICATIONS OF CLEARANCE FOR IMPORTED SUGAR AND SHIPPING PERMIT FOR COASTWISE MOVEMENT OF SUGAR



The Sugar Regulatory Administration (SRA) in the exercise of its regulatory function concerning the disposition of locally produced and imported sugar in the domestic market with primary objective of preventing the entry of smuggled sugar into the aforesaid market hereby clarifies the following regarding the clearance and shipping permit issued by the SRA relative to sugar importation and movement, to wit:

1.         Clearance for the Release of Imported Sugar

The clearance for imported sugar is being issued by the SRA to sugar importer/consignee as a requisite prior to withdrawal of the sugar from the custody of the Bureau of Customs (BOC).

The said clearance addressed to the BOC explicitly indicates therein the port of entry or the place to where the imported sugar shall be unloaded, hence, the clearance can be only applicable to one definite place and not to any other ports of entry.

However, in the event the imported sugar shall be transported from one port to another, the shipper/owner (not necessarily the importer/consignee) of the imported sugar shall apply with the SRA for a shipping permit attached to the application a copy of the clearance as one of the requirements pursuant to Sugar Order No. 12, Series of 1987-88, as amended by Sugar Order No. 3, Series of 1998-1999.

2.         Shipping Permit for Coastwise Movement of Sugar (subject of Sugar Order No. 12, Series of 1987-88, as amended by Sugar Order, No. 3, Series of 1998-99).

The shipping permit issued by the SRA applies to all locally produced and imported sugar (already cleared with the BOC) being transported from one port to another with the purpose of assuring all concerned government agencies, e.g., BOC, Philippine Coast Guard, Philippine Ports Authority (PPA) that the sugar, whose volume and markings are manifested in the said permit, is not smuggled sugar.

All concerned should be guided accordingly.
