[ PVAO SUPPLEMENTARY GUIDELINES NO. 90-08, September 25, 1990 ]

CLAIMS FOR OLD-AGE PENSION DUE THE ESTATE OF DECEASED VETERANS OR THEIR SPOUSES



1.  Old-age pension under the provisions of Sections 10 and 11, Republic Act No. 6948, and Sections 44 and 45, Department of National Defense Order No. A-049, c.s., due the estate of a deceased veteran or his widow shall be claimed in due form by his/her legal heirs in the following cases:
  1. When the veteran or his widow had applied for the benefit but predeceased the approval of his/her claim; or

  2. When the veteran or his widow had no opportunity to apply for the benefit before his/her death occurring on or after 9 April 1990.
2.  The Legal and Investigation Division shall in any case determine the legal heirs and their corresponding shares in the old-age pension due and accruing in favor of the estate of the deceased until and including the date of his/her death pursuant to the applicable provisions of the Civil Code of the Philippines.

3.  The prescribed forms (PVAO Form No. 90-03-A OV and PVAO Form No. 90-03-A OW) for the claims referred to hereinabove, which are appended hereto and hereby made part of these supplementary guidelines, shall be provided the claimants concerned for accomplishment and submission to the Office together with the supporting documents indicated therein.  In the case, however, of claims filed in other forms substantially approximating the ones herein prescribed, it shall be deemed sufficient compliance with the requirements of the Office; provided, however, that the claimants concerned be required to submit the supporting documents indicated in the prescribed forms.

4.  The term “widow” used hereinabove shall be construed to mean or include the term “widower” pursuant to the definition of “surviving spouse” under Section 2-(j) of Republic Act No. 6948 and Section 2-1 of Department of National Defense Order No. A-049, c.s.
