DETENTION OF SUSPECTS AND/OR ACCUSED



Our detention facilities is holding detainees above and beyond its rated capacity.  The problem of security also arises not to further mention the maintenance expense incurred by the Bureau for these detainees.  It has been further observed that the Agents-on-case of these detainees do not follow-up the filing of information in order that the appropriate Warrants of Arrest or detention orders are issued by the courts.

Time and again we have given instructions that detainees must immediately be turned over to the corresponding City or Provincial Jail with appropriate jurisdiction over the case so that the matter of escorting these detainees for court appearances can also be avoided.

Henceforth, it is hereby ordered that the Agents-on-case must see to it that the person arrested must immediately be turned over to the corresponding jail.  A maximum of three (3) days is allowed.  Beyond this time, unless for valid or compelling reasons, the Agents will be required to explain why these detainees are overstaying in our detention facilities.

Strict compliance is enjoined.
