[ BFAR ADMINISTRATIVE ORDER NO. 170, August 10, 1990 ]

PROHIBITING THE OPERATION OF "SUDSUD" (SCISSOR OR PUSHNET) IN PANGUIL BAY



Pursuant to the provision of Section 4 and 7 of Presidential Decree No. 704, otherwise known as the "Fisheries Decree No. 1975", the following rules and regulations are hereby promulgated for the information and guidance of all concerned:

SECTION 1. Definition of Terms - "Sudsud" (scissor or puh net) means a fishing gear with nettings mounted on two (2) collapsible bamboo or wooden poles fitted with or without wooden flat shoelike device and operated on a motorized fishing boat.

SECTION 2. Prohibition - It shall be unlawful for any person, corporation , association , partnership or cooperative to operate "sudsud" (scissor or puh net) in catching fish and/or other fishery aquatic products in Panguil Bay.

SECTION 3. Penal Clause - Any violation of this Order shall subject the offender to the penalty of fine from Five Hundred Pesos (P5,00.00 ) to Five Thousanf Pesos (P5,000.00) or imprisonment in the discretion of the Court: Provided, however, That the Director of Fisheries And Aquatic Resources is hereby empowered to impose upon the offender an administrative fine of not more than Five Thousand Pesos (P5,000.00) or to cancel the commercial fishing boat license or to impose both such fine and cancellation of the license at his discretion.

SECTION 4. Repealing Clause - All existing administrative orders, rules and regulations and parts thereof which are inconsistent with the provisions of the Order are hereby modified or repealed accordingly.

SECTION 5. Effectivity - This Order shall teke effect fifteen, (15) days after its publication in the Official Gazette and/or in two (2) newspapers of general circulation.
