[ PRC BOARD OF MEDICINE RESOLUTION NO. 23, s. 1994, May 17, 1994 ]

AMENDMENTS TO BOARD RESOLUTION NO. 06, S. 1991



WHEREAS, Res. No. 06, Series of 1991: “The Guidelines for Granting Permit to Foreign Doctors Conducting Medical Mission Sponsored by Local Private Organizations” calls for revision so as to keep abreast of the continuing and increasing requests by foreign physicians for special permit to practice medicine in the Philippines under medical mission; and

WHEREAS, the grant of the said permit is not objectionable provided that Sec. 12 (a) (second position thereof), Art. III of R.A. No. 2382, as amended: “The Medical Act of 1959” is fully met,

NOW, THEREFORE, by virtue of its quasi-legislative (rule-making) power under Sec. 22 (5), Art. III of R.A. No. 2382, as amended: “The Medical Act of 1959”, the Board hereby RESOLVED, as it so RESOLVES, to effectuate the hereunder amendments to the provisions of Board Res. No. 06, Series of 1991.

SECTION 1.  Rule 4.5 (Rules and Guidelines), Requiring posting of a bond, shall be deleted or repealed.

SECTION 2.  Rule 5.1, requiring reciprocity with the applicant’s foreign country, shall be deleted.

SECTION 3.  Rule 5.6 shall now read, to wit:

5.6.      Applicant shall submit to the Board through the Commission his application together with all documents in support thereof on a date not later than sixty (60) days before the start of the medical mission.”

SECTION 4.  This rule shall be included, to wit:

“6.     No permit shall be issued unless the local medical society and/or specialty society involved has given a favorable indorsement to the Board”.

SECTION 5.  The herein resolution, upon approval by the Commission shall be effective after fifteen (15) days following its publication in the Official Gazette or any newspaper of general circulation.

SECTION 6.  A copy of the herein resolution shall be furnished to the Department of Health (DOH), the Philippine Medical Association (PMA), the Philippine Hospital Association (PHA) and the Department of Foreign Affairs and other affected governmental association.
