APPROVING THE INCREASE OF FISHPEN AND FISHCAGE FEES, THE IMPOSITION OF RELATED FEES AND THE ADOPTION OF POLICY GUIDELINES ON THE PAYMENT OF FISHPEN AND FISHCAGE FEES



WHEREAS, the Authority under Section 3 of Executive Order No. 927, is empowered to collect fees for the use of lakewaters and tributaries for all beneficial purposes including but not limited to fisheries, recreation, municipal, industrial, agricultural, navigation, irrigation, and waste disposal;

WHEREAS, the Authority depends largely on internal revenue realization from fishpen/fishcage and environmental regulatory fees, among other sources of funds, to support its operational expenses since it does not receive any subsidy from the National Government;

WHEREAS, the Authority would require sustainable financial resources to be able to fully operationalize the Task Force for the Laguna de Bay 2000; and

WHEREAS, the fees for the use of lakewaters for fisheries, which represent 40% of the Authority’s revenue sources, could be tapped to generate the needed funds since the latest adjustment in rates was done in 1988;

NOW, THEREFORE, in consideration of the above premises, BE IT RESOLVED, as it is hereby RESOLVED, to approve the following:

1.   Increase of fishpen fee rate from P1,400/hectare/annum to P2,500/hectare/annum.

2.   Increase of fishcage fee from the P0.12/sq.m./annum to P0.15/sq.m./annum:

3.   collection of fees for the issuance of stocking permit at P0.05/fingerling to be stocked; and

4.   collection of fees for the issuance of clearance permit for the repair of fishpen or fishcage at P5.00/piece of bamboo, P10.00/piece of anahaw and P50.00/bundle of nets to be used in the repair.

RESOLVED, FURTHER, that the following guidelines in the payment of fishpen and fishcage fees to be adopted:

1.   Full payment of fishpen and fishcage fees shall be made within the first quarter of the year;

2.   Full payment made within the first quarter of the year shall be granted five per cent (5%) discount;

3.   Late payment shall be charged five per cent (5%) surcharge for every month of delay;

4.   Applications of late registrants and fishpen/fishcage owners with unpaid accounts as of the first quarter shall be re-evaluated and five per cent (5%) surcharge shall be imposed on them once their applications are approved; and

5.   Payments, made through check shall be considered valid only upon its acceptance by the drawee bank.

RESOLVED, FINALLY, that implementation of this resolution shall take effect within thirty (30) days after its publication in any newspaper of general circulation.
