[ BFAR ADMINISTRATIVE ORDER NO. 172, November 12, 1990 ]

ESTABLISHING A FIVE YEAR CLOSED SEASON ON THE OPERATION OF COMMERCIAL FISHING BOATS AND THE EMPLOYMENT OF "HULBOT HULBOT" BY BOTH COMERCIAL AND MUNICIPAL FISHING BOATS IN POLILLO STRAIT AND A PORTION OF LAMON BAY, QUEZON PROVINCE



The following regulation for the protection and conservation of the fisheries and aquatic resources in Polillo Strait and a portion of Lamon Bay in Quezon province is hereby promulgated pursuant to Section 3 9b), 4 and 7 of Presidential Decree No. 704, as amended, and Section 1, Presidential Decree No. 1015 for the information and guidance of all concerned.

SECTION 1. Definition of Terms - The following terms as used in this order shall be construed as follows:

a. Polillo Strait and a portion of Lamon Bay, Quezon Province - refers to that body of marine waters, beginning at a point marked "1" on the map being Deseada Point part of General Nakar Quezon province which is 15o 10' 55" N. Latitude, 121o 28' 52" E. Longtitude; thence to point 2, Bulubalic Point of Polillo Island at 15o 02' 52" N. Latitude, 121o 59' 35" E. Longtitude; thence to point 3, Kalongkooan Island 14o 57' 18" N. Latitude, 122o 09' 35" E. Longtitude; thence to Point 4 eastside tip of Jomalig Island 14o 42' 28" N. Latitude, 122o 26' 15" e. Longtitude; thence to Point 5, Agta Point southern part of Polillo Island with 14o 37' 45" mouth of Piapi River 14o 24' 05" N. Latitude, 121o 39' 28" E. Longtitude; traversing the coastline of Real, Infanta and General Nakar to the point of beginning, containing an area of 300, 037 hectares, more or less.

b. "Hulbot-hulbot" - Where the context so admits or requires, the expression shall refer to that kind of fishing gear, otherwise known as "buli-buli", "pahulbot-hulbot", "palisot", "patngko", "bira-bira", or "liba-liba", which is a conical net having a pair of wings, the ends of which are connected to two ropes with hard plastic strips or similar materials serving as a herding or scaring device, with hauling ropes passing through a metallic ring permanently attached to a tom weight, know as "linggote" in the vernacular, when hauled into the fishing boat.

SECTION 2. Prohibition - It shall be unlawful for commercial fishing boats using any kind of fishing gear, and municipal and commercial fishing boats employing "hulbot-hulbot", to be operated within the Polillo Strait and a portion of Lamon Bay, Quezon province during the five-year closed season from the effectivity of this Order; Provided, That the Secretary of Agriculture, upon recommendation of the Director of Fisheries and Aquatic Resources, may suspend, lift or terminate earlier the cloased season period hereby established for the purpose of allowing the commercial fishing boats employing certain fishing gear, other than commercial purse seine and trawl banned from the seven kilometer distance under Letter of Instructions No. 1328 in relation to Fisheries Administrative Order No. 156, and both municipal and commercial fishing boats employing "hulbot-hulbot" in fishing in the aforedescribed area, as determined by scientific studies through proper monitoring, assessment and evaluation of the fisheries and aquatic resouces of the marine waters by the Department od Agriculture Regional Office No. IV.

SECTION 3. Penalty - Violation of this order shall subject the offender to the penalty of finie fron five hundred (P500.00) to five thousand (P5,00.00) pesos ot imprisonment from six (6) months to four (4) years, or both such fine and imprisonment in the discretion of the Court: Provide, that the Director of Fisheries and Aquatic Resources is hereby empowered to impose upon the offender an administrative fine of not more than five thousand (P5,00.00) pesos including the confiscation of the fish caught, gear and other fishing paraphernalia used in the commission of the crime in accordance with Article 45, Revised Penal Code in relation to Section 2, Rule 126 of the new Rules of Court.

SECTION 4. Repealing Clause - All existing administrative orders, rules and regulations or parts thereof inconsistent with this Order are hereby repealed or modified accordingly.

SECTION 5. Effectivity - This Order shall take effect fifteen (15) days after its publication in the Official Gazette and/or in two (2) newspapers of general circulation.
