[ DTI DEPARTMENT ADMINISTRATIVE ORDER NO. 8, S. 1999, August 20, 1999 ]

DEPUTIZING THE HOUSING AND LAND USE REGULATORY BOARD (HLURB) TO ACCEPT APPLICATIONS FOR LICENSING OF NCR-BASED REAL ESTATE BROKERS AND SALESMEN, AND TO TRANSMIT SAME TO DTI-NCR



WHEREAS, the DTI is empowered under Section 3 (e) and (ee) of Act No. 2728 as amended by Act Nos. 3715 and 3969 to license real estate brokers, including real estate salesmen;

WHEREAS, under Presidential Decree No. 957 as amended, HLURB is empowered to register real estate brokers and salesmen dealing in condominium and subdivisions units;

WHEREAS, the real estate industry in the National Capital Region in a number of consultation with the realtors organization and other stakeholders continues to press for integrated registration of NCR-based real estate brokers and salesmen;

WHEREAS, HLURB is willing to accept the subject deputation;

NOW, THEREFORE, the following are hereby ordered:

Section 1. HLURB is hereby deputized to perform the following functions:

a.
Accept applications for licensing of NCR-based real estate brokers and salesmen, including the supporting documents and bonds; and preliminarily evaluate them as to whether or not they meet the licensing requirements embodied in DTI's Ministry Order No. 39, S. 1985 as amended (rules and regulations governing the licensing of real estate brokers, salesmen, etc.); and transmit same to the DTI-NCR;
 
b.
Collect the licensing fees therefor, and remit same to DTI-NCR.

Section 2. DTI-BTRCP and HLURB shall enter into a Memorandum of Agreement which shall fix the details of this deputation, e.g., duration of the deputation and time frames for transmittal/remittance.

Section 3. This Department Administrative Order shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation, per E.O. 913 (issued 1983).
