[ BAI MEMORANDUM ORDER NO. 05, S. OF 2010, February 09, 2010 ]

LIFTING THE TEMPORARY BAN ON THE IMPORTATION OF DOMESTIC AND WILD BIRDS AND THEIR PRODUCTS INCLUDING POULTRY MEAT, DAY OLD CHICKS, EGGS AND SEMEN ORIGINATING FROM SPAIN



WHEREAS, based on the report submitted to the Office International des Epizooties (OIE) by Dr. Lucio Ignacio Carbajo Goni, Subdirector General de Saridad de la Production Primaria, last 27 January 2010, Spain declares that the H7 Highly Pathogenic Avian Influenza (HPAI) incident has been successfully eradicated;

WHEREAS, preliminary cleaning and disinfection operations at the affected establishments were completed last 29 October 2009

WHEREAS, restrictive measures in the protection and surveillance zones were lifted when no further outbreaks were detected;

WHEREAS, in accordance to Article 10.4.3 of the OIE Terrestrial Animal Health Code (2008), Spain declares that it regains its notifiable avian influenza free country status on 29 January 2010;

WHEREAS, based on the evaluation of the Bureau of Animal Industry (BAI), the risk of contamination from importing poultry and poultry products from Spain is negligible;

NOW THEREFORE, I,  ATTY. ARTHUR C. YAP, Secretary of Agriculture, by the powers vested in me by law, do hereby lift the temporary ban on the importation of domestic and wild birds and their products including poultry meat, day old chicks, eggs and semen originating from Spain.

All import transactions of the above products shall be in accordance with the existing rules and regulations of the Department of Agriculture, Bureau of Animal Industry and National Meat Inspection Service (DA-BAI-NMIS).

All orders, rules and regulations or parts thereof, which are inconsistent with the provisions of this order, are hereby repealed or amended accordingly.

This ORDER shall take effect immediately
