[ LTFRB MEMORANDUM CIRCULAR NO. 2005-020, July 07, 2005 ]

SUPPLEMENT TO MEMORANDUM CIRCULAR NO. 2005-015 DATED MAY 12, 2005, RE: RATIONALIZATION PROGRAM FOR THE VOLUNTARY CONVERSION OF TOURIST BUS CERTIFICATES OF PUBLIC CONVENIENCE (CPCS) TO PUB AIRCON FRANCHISES



In addition to the terms and conditions provided in paragraph 4 of Memorandum Circular 2005-015, Re: RATIONALIZATION PROGRAM FOR THE VOLUNTARY CONVERSION OF TOURIST BUS CERTIFICATES OF PUBLIC CONVENIENCE (CPCs) to PUB AIRCON FRANCHISE, the following requirements should likewise be complied with by the applicant for conversion:

    1. Only existing franchise holders on their respective authorized route shall be allowed to avail of the application for conversion. The route subject of the conversion shall depend on the authorized route granted to the applicant as franchisee of Tourist Bus Service;

    2. Only unexpired CPCs are allowed for conversion;

    3. Intra-Regional (those issued by Regional Offices) CPCs to operate Tourist Bus Service are not covered by conversion for Inter-Regional route/s, nor it can be the subject of sale for purposes of conversion;

    4. In case of opposition by any affected operator/s in the route applied for conversion, this Board will adopt a summary proceeding by directing the parties concerned to file their respective position paper within an unextendible period of ten (10) days from receipt of the opposition. Thereafter, this Board will submit the said case for resolution;

    5. Applicants for Conversion are prohibited to drop and substitute their authorized units within a period of one year from date of issuance of the Decision, nor said CPCs can be subject for sale and transfer within the same period of time; and

    6. Deadline for filing of such application for conversion is on August 15, 2005.

This Memorandum Circular supersedes any and all issuances inconsistent herewith, and takes effect immediately following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
