[ BI MEMORANDUM CIRCULAR NO. MCL-09-008, August 07, 2009 ]

FURTHER AMENDING MEMORANDUM CIRCULAR NO. MCL-09-005 DATED 08 JULY 2009, AS AMENDED, PROVIDING FOR THE “IMPLEMENTING GUIDELINES OF THE BUREAU OF IMMIGRATION (BI) REGIONALIZATION PROGRAM”



WHEREAS, Department of Justice (DOJ) Memorandum Order No. 04 entitled “Establishing the Immigration Area Offices in the Bureau of Immigration. Defining the Functions, Duties and Responsibilities Thereof, and For Other Purposes” was issued on 13 July 2009;

WHEREAS, pursuant to the aforementioned Memorandum Order, the Immigration Commissioner issued on 08 July 2009 Memorandum Circular No. MCL-09-005 providing for the “Implementing Guidelines of the Bureau of Immigration Program”;

WHEREAS, Section 16 [a] of the Memorandum Circular No. MCL-09-005, as amended, by Memorandum Circular No. MCL-09-007, dated 31 July 2009, provides that the “Bureau’s international airport and seaport operations, bay service and border crossing activities shall continue to exercise its mandated functions, duties and responsibilities and shall be under the control and supervision of the Immigration Regulation Division (IRD)”;

WHEREAS, on 13 July 2009, the DOJ issued Memorandum Order No. 8 entitled “Constituting an Airport Operations Division (AOD) in the Bureau of Immigration and For Other Purposes”, whereby a separate division directly under the Office of the Commissioner was created to perform enforcement and administration of immigration laws functions within the immigration premises and areas in all the existing operational international ports of entry/exit (i.e., Ninoy Aquino International Airport [Terminals 1, 2 and 3], Diosdado Macapagal International Airport, Mactan-Cebu International Airport, Davao International Airport, Tuguegarao City Airport, Laoag International Airport; Kalibo International Airport, Puerto Princesa Airport and Zamboanga International Seaport) as well as other airports and seaports which may thereafter be declared as international ports of entry/exit and operated as such;

WHEREAS, with the constitution of such Airport Operations Division (AOD), there is a need to further amend Memorandum Circular No. MCL-09-005 to accurately define and represent the organizational line of authority and structure of the AOD vis-a-vis the IRD;

NOW, THEREFORE, for and consideration of the foregoing premises, Section 16 of MEMORANDUM ORDER NO. MCL-09-005 is hereby further amended to read as follows:

Section 16. Bay Service and Border Crossing Activities - [a] The Bureau’s bay service and border crossing activities shall continue to exercise its mandated functions, duties and responsibilities and shall be under the control and supervision of the Immigration Regulation Division (IRD).

[b] In cases where operations and activities of the IAO shall involve and affect specific concerns of the bay service and border crossing under the Immigration Regulations Division (IRD), and international airports/seaports under the Airport Operations Division (AOD), the same shall be coordinated with the respective Chiefs thereof.”

This Memorandum Circular shall take effect immediately upon approval and posting in the official BI website.
